If the election is considered to have “failed” and no clear winner is chosen, the Florida legislature can decide which slate of electors is sent.
If no electors are chosen and the current president’s term expires, the speaker of the house becomes president.
If Kerry can show fraud occurred and that he was the rightful winner, then he can lay claim to the electoral votes. If he shows fraud but not by enough to win, then it seems like he would still lose – but the federal government would investigate and charge the culprits. (It’s not worded well enough to know whether this is a loophole or not.)
