Anyone know the makeup of the Ohio Supreme Court??
Any court challenges in Ohio will likely be decided by the Ohio Supreme Court ultimately since Rehnquist is thankfully on his deathbed and will be unable to make a ruling. Do Dems have the advantage in the Ohio Supreme Court??

3. Won't matter if Rehnquist is sidelined
The US Supreme Court could rule on it but without Rehnquist there would be a 4-4 tie, and it by law it would default to the Ohio Supreme Court ruling. If that had happened in FL in 2000, Gore would be Prez.

i looked at all their profiles - most of them sound like they'd be more conservative, except for Alice Robie Resnick who seems to be a women's rights activist...

6. I heard he can phone in his vote
so unless he is in a coma Rehnquist can tip the decision - but you know some how I'm wondering if Sandra Day O'Connor would vote the same way she did the last time - she wanted to retire and never did during the first term - I've always suspected she didn't because she felt guilty - and I have nothing to base that on but my feeling....and wondering why she didn't retire.

9. Not at all silly

it was on an Air America program - he does not have to be present to vote - I think it was on Al Franken but not sure and they specifically asked and expert and were told Rehnquist does not have to be present to participate.

I would have thought it was silly that they would stop the vote count in 2000 - but they did. They would stop at nothing to get what they want.

On edit:

You know I really don't like being called silly so I just did a google and here is what I found:

"Justice John Paul Stevens presided in the chief justice's absence, announcing that Rehnquist "reserved the right" to vote in the cases he missed based on the briefs and transcripts of the arguments."

I'd be happy to accept your apology....

12. You are correct
Rehnquist is still voting despite not being in the court to hear arguments and ask questions.

It's a fact.

Tight Ohio Supreme Court Stays in Republican Hands
November 10, 2004

Republicans solidified their year-old voting majority on the Ohio Supreme Court last wek, but the races were closer than the vast campaign fund-raising advantage over Democratic rivals would indicate
