SHELBY, TN: 3,221 PHANTOM VOTES FOUND; SAME LOCATIONS HAD UPLOADS DAY BEFORE ELECTION

Consultants examining the Aug. 5 Shelby County election found 3,221
more votes than voters on documents provided by Shelby County
elections officials pursuant to a court order.

Most voterless votes were found in large Republican precincts, a
non-random distribution.

The inspection team sought and obtained documents in connection with a lawsuit filed by ten defeated candidates over irregularities in the
election.

FOUR KINDS OF INFORMATION ARE NEEDED TO AUTHENTICATE AN ELECTION:
1. Who can vote (the voter list)
2. Who did vote (the list of participating voters)
3. Were votes cast the real ones (chain of custody)
4. Was the counting accurate (public verification of the count)


Shelby County admitted that they installed an invalid voter list in
Election Day electronic poll books, altering #1 (WHO CAN VOTE). The
list said thousands of people could not vote because they had already
voted, even though they had not voted.

Shelby County withheld the list of WHO DID VOTE (#2 ) until ordered by the court to produce it. When consultants analyzed the list of who did vote, they found names missing for 3,221 votes counted in the final certified results.

Shelby County computer logs show uploaded invisible data from 16
polling places the day before the polls opened. The premature uploads
were done out of public view, and no testing procedure or work order
record matches documents the uploads of invisible votes into the
central tally machine, raising questions on WHETHER VOTES COUNTED WERE
THE REAL ONES(#3).

#4, COUNTING OF THE VOTE: Shelby County declined to provide precinct results after the election and even after they certified the results; Elections Administrator Richard Holden stated in front of a court reporter on Aug. 16 that it was not possible to produce them, a
misrepresentation to the court, but the inspection team discovered
copies of precinct results reports sitting on Shelby County computers.
The results had been there since Aug. 6. Shelby County precinct
results ("Statement of Votes Cast" or "SOVC") do not match the list of
participating voters.

A meeting is being held tonight, Thursday Sept. 16, for all citizens
and the media to hear details on the evidence. Shelby County Voter
Protection meeting: 6:00 pm at Morning Star Holiness Church - 3161
Park Ave Memphis TN 38111-3043

Shelby County's certified "SOVC" results show 85,290 votes cast at
polls (not early votes, or absentee votes, but Election Day polling
place votes. But Shelby County's Participating Voter List shows only
82,069 voters who cast votes at polls.

Also, in at least five locations containing phantom votes -- votes
without voters -- Shelby County had performed secret uploads from
voting machines the day before the election.

PRECINCT: COR09

The heavily Republican COR09 precinct, location HOPE PRESBYTERIAN
CHURCH shows just 20 people who voted at the polling place, but the
certified "SOVC" results counted 619 votes. This is a discrepancy of
599 votes.

5. My recollection is the lily-white candidates swept offices, often running counter to previous
voting results which raises the question of whether it is now possible to steal elections under the circumstances described herein? :shrug:

... a correction of that previous number or does it relate to something else?

I really believe the Shelby county elections were stolen. I just wish someone else besides Bev was doing the post-election analysis, given her very-checkered track record.

Bev,

Thank you for your work in Sheby county. Those of us who remain strongly protective of election integrity in Tennessee appreciate the opportunity to not only re-engage these issues but to (finally) put some Volunteer State election thieves in jail. Here's hoping you provide the "smoking guns" in short order in the birthplace of the blues. It appears you have.

One quick question: For those of us speaking and blogging about this issue in a variety of statewide forums right now, can you explain the two different "phantom vote" numbers we have now heard: the earlier number (a) (n=6,800+), or the new number (b) (3,221) presented in this article. (Please forgive me if I have mistated (b) -- I can't both type you this message and toggle back to the article.

Specifically, is (b) a subset of (a)?
Or is (b) an updated replacement for (a)?

Please help us use these numbers appropriately here in Tennessee. Believe me, they are being used already, from the birthplace of the blues to the birthplace of the nation (at the other end of our state). And many points in-between.

Including Athens, TN.

Bev emailed me to say she was not the source for the earlier number. I checked and found the source was an August 25 press release related to two lawsuits filed in Shelby County over the recent August 5 election theft. Here's a segment of the press release.

FOR IMMEDIATE RELEASE: August 25, 2010

A PRESS CONFERENCE WILL BE HELD ON WEDNESDAY, AUGUST 25TH, AT 11:00 AM ON THE SOUTH SIDE OF THE COURTHOUSE AT 140 ADAMS AVENUE.

AUGUST CANDIDATES FORMALLY SUE DUE TO IMPROPRIETIES IN ELECTION

Ten coun­ty­wide can­di­dates in the August 5th elec­tion have for­mally filed an elec­tion con­test in Shelby County Chancery Court request­ing injunc­tive relief. The ten plain­tiffs in the suit include cer­tain non-partisan judi­cial can­di­dates as well as cer­tain Demo­c­ra­tic nom­i­nees, all of whom com­peted in the County Gen­eral Elec­tion ear­lier this month. Based on an inspec­tion and inves­ti­ga­tion of the Shelby County Elec­tion Com­mis­sion (SCEC) and of August 5th elec­tion records, the suit claims that the elec­tion process was incur­ably flawed to the extent that the cit­i­zens of Shelby County were denied a free and equal elec­tion as required by Arti­cle I of the Ten­nessee Constitution.

The suit alleges wide­spread irreg­u­lar­i­ties, impro­pri­eties, dis­crep­an­cies and vot­ing prob­lems so sig­nif­i­cant as to have affected the out­come of the August elec­tion and to have caused the elec­tion results to be incur­ably uncer­tain. Already known is the mas­sive error already acknowl­edged by the SCEC and described by the SCEC itself as “unac­cept­able” where invalid and inac­cu­rate voter eli­gi­bil­ity records were pro­vided to polls on Elec­tion Day poten­tially affect­ing 5,400 vot­ers and turn­ing away thousands.

“This law­suit is intended to assure that the OTHER sub­stan­tial and appalling impro­pri­eties which occurred in the August elec­tion are brought to light, inves­ti­gated and resolved for all cit­i­zens and for every future elec­tion. The han­dling and mis­han­dling of the August elec­tion by the SCEC is an embar­rass­ment to our county and a vio­la­tion of every prin­ci­ple on which our coun­try was founded. Regard­less of race, party or gen­der, every cit­i­zen is enti­tled to bet­ter and is enti­tled to an unim­peded and trans­par­ent vot­ing process. Our upcom­ing Novem­ber elec­tion, includ­ing the vote on con­sol­i­da­tion of Mem­phis and Shelby County, is impor­tant to many, and we intend to do every­thing in our power, with the approval of the courts, to assure that every citizen’s vote counts. None of us should tol­er­ate incom­pe­tence or impropriety.”

Exam­ples of prob­lems from the suit:

1. Votes With­out Vot­ers: Accord­ing to SCEC records, the Par­tic­i­pat­ing Vot­ers List for the August elec­tion includes 176,119 vot­ers. With­out expla­na­tion, the Cer­ti­fied State­ment of Votes Cast shows 182,921 votes as being cast in the August 2010 elec­tion. Thus, accord­ing to SCEC’s own records, 6,802 more votes were cast than indi­vid­u­als who par­tic­i­pated in the August 2010 election.

The good news about all this is that this larger number was data provided directly by the Shelby County Election Commission that reflected the entire election and not just the election day votes cast at the polls (which was the focus of Bev's report.) Thus, the great news is that both Bev's announced number and this larger number may be correct, with Bev's number being a subset of the larger figure.

It's clear that these numbers support allegations that a multi-faceted election fraud was committed at all levels of the recent Shelby county election and affected not only the fraudulent counts of votes cast on August 5 but also the early voting and absentee voter numbers. This mounting evidence of felonious election fraud demands that any and all questions about the recent election be answered without further delay AND that any and all data, hardware, software and related materials relevant to a forensic investigation of this election be surrendered immediately.

Anything less is more evidence of the crime and adds other felony charges against these corrupt country-club cracker perps ... in the birthplace of the blues.

There is a history, here and elsewhere, that I should not have allowed to enter this discussion. I will behave better from this point on, in great part because every Tennessean owes a debt to Bev and Susan for doing the dirty work to uncover election theft in the birthplace of the blues.

My guess is that our TN elections have been manipulated on unverifiable voting equipment for a decade or more (e.g., the 2008 legislative races are a case in point.) However, the Memphis election thieves are both ignorant AND arrogant -- they thought they could get away with anything. (It's not like they don't have good models for similar success. Witness the South Carolina Democratic primary this year.) Fortunately, these Shelby county corrupt country-club crackers seem to have left fingerprints all over the place.

Hurry sundown ... and justice ... in the birthplace of the blues.
