Apparently the illegal destruction of public records is okay as long as you had legal counsel?

DuPage stands by destruction of election files

Commission differs with state's opinion

The DuPage County Election Commission has asserted for years that it has the right to destroy election records, most just a few months after Election Day. But a state agency says the county is wrong in trashing files without first getting permission from the Illinois secretary of state's office.

Election Commission members met in closed session Tuesday to discuss a recent official opinion by the Illinois attorney general that says the commission is subject to the requirements of the state Local Records Act, which requires that local governments get permission from the Local Records Commission before destroying official documents.

Unauthorized destruction of government records can be a felony, but DuPage State's Atty. Joseph Birkett said Monday that he does not contemplate any enforcement of the law in this case.

"The Election Commission was acting in good faith on the advice of counsel on a matter in which there was a legitimate difference of opinion," Birkett said, adding: "I think everyone will accept the attorney general's opinion and just move on."

6. What are they covering up? And how far up the chain does this go?
Dupage has a well-earned bad reputation in Election Integrity circles, but it almost seems like the cancer has spread up to the state level. Do the Reeps on that BOE have compromising pictures of the AG in a hot tub or something?

7. What makes Illinois unique is...
...the Secretary of State and the State Board of Elections are toothless. They have NO JURISDICTION over the election boards and commissions. There's really no where to go for help.

All counties at least have a county board to provide oversight, EXCEPT for one county -- DuPage. DuPage is the only county with a county-wide election board which is a separate entity. So there's zero oversight.

Or was it Homewrecker Hank? Either way, it's a guaranteed way to steal any election that includes DuPage County.
