“Lawsuit over state elections survives dismissal hearing. A federal judge ruled last week that a lawsuit challenging the state’s election system can go forward for now. A coalition of voter advocates, led by the League of Women Voters of Ohio, sued Ohio Secretary of State J. Kenneth Blackwell and Gov. Bob Taft in July, arguing they and predecessors failed to ensure voting rights.”
“A federal judge ruled last week that a lawsuit challenging the state’s election system can go forward for now. A coalition of voter advocates, led by the League of Women Voters of Ohio, sued Ohio Secretary of State J. Kenneth Blackwell and Gov. Bob Taft in July, arguing they and predecessors failed to ensure voting rights. In an order Nov. 21, Judge James G. Carr, of U.S. District Court in Toledo, rejected a motion to dismiss the case.”
“The state argued, in part, that the lawsuit was moot because it sought changes before the statewide election that was held Nov. 8. Voter advocates said their intention was to have changes by the November 2006 election, and Carr is allowing them to amend their complaint by Wednesday. The judge also rejected a defense motion to stop providing documents and other evidence. That means Blackwell, Taft and the county elections boards must continue providing the records requested.”
