Sequoia lawsuit update 5-11-05

A brief pause in the action to restore real elections while my attorney Randy Gordon takes the Catholic Church to trial for sexual abuse problems here in Washington State.

After he does his best for two weeks to clean up that situation, (already 3 days into it) then it will be back to elections.

I continue to have some radio opportunities in Bellingham and other places, on Sunday I will be part of a panel at the Everett, WA public library that includes an official from the SEcretary of State's office, legislators, and others on election reform. Should be fun! Sunday from 2pm to 4pm in case anyone is local. Everett Public Library on Hoyt Avenue, downtown Everett.

2. LS, what can you share with us now?
We have a Memphis (TN) attorney interested in filing a similar case here, but I haven't met him yet. Can we get access to your initial filings and related documentation?

We want our state legislature to think about the many different ways we can get back to trustworthy and people-controlled and -centered (not corporately-outsourced) elections here in the Orange State. Sensible legislation sure beats protracted litigation.

7. Sequoia has removed the lawsuit to federal court just now....
They have the "right" to do so, subject to our motion if we choose to make it to remand it to state court, and seek attorney fees and costs for the removal to federal court.

This has the effect of delaying discovery somewhat, but ultimately discovery goes faster in federal court because both sides are obligated to show their cards so to speak representing evidence of their claims and defenses. However, if trade secrets are not part of Sequoia's claims or defenses they wouldn't have to produce them without receiving a request to do so....

Do you have contact info for people on the NJ Task Force on Voting? If so, it would be wise to run this by them. Coalition for Peace Action already has begun a lawsuit. Visit the website at: peacecoalition.org - they are the clearing house for scoops on voting issues. And, at a movie event last week, Bob Moore told the crowd we are fighting for auditable paper records on multiple fronts.

Citing past malfunctions by the machines manufactured by Sequoia Voting Systems, Diebold, and ES&S, Assemblyman Reed Gusciora (D-Princeton Borough), a plaintiff in the suit, said that the state may have overlooked certain safeguards and indicated that state legislation should be put forth to address problems with voting machines. Currently, 16 out of 21 counties in New Jersey use electronic machines, all of them manufactured by Sequoia.

12. NJ Task Force on Voting?--hmmm not sure
is that comprised of Appleseed and Acorn members amoung others?

That lawsuit in NJ has to be reinstated---which sort of takes it out of play---------

Ive been able to offer some help to "Pam" who is taking over the effort down in Mercer. Shes Meeting w/freeholders IIRC this week.

CFPA has its hands full--in North Jersey there is no such group---which is what I'm trying to build. NOw.

11. Hi LS! what is your take on city council candidates in close elections
getting local access to voting machine info. I think we might be successful at a local level with getting a compliant candidate and judge to file suit. What might it look like and where might be good to try?
