Blackwell, Glenda Hood, NM SOS all on one panel EAC-Col OH
WE NEED FOR YOU TO CONTACT THIS PANEL
Provisional Ballot Hearing on Feb 23 Columbus OH

Testimony for the public hearing on PROVISIONALvoting may be submitted in writing to EAC at testimony@eac.gov.

Check out this line-up
from their website:
"We know that provisional ballots enabled more than one million
Americans to vote on Election Day 2004," remarked EAC Chair Gracia
Hillman. "These were voters who were eligible to vote, but without the
protection of HAVA, they would have been denied their right to cast a
ballot. Preliminary data collected from 41 states also shows that more
than 500,000 provisional ballots were not counted. It is important for
us to learn more about the successes and failures of provisional voting
in order to assist election officials in conducting this type of voting
in the future."
The public hearing will feature three panels comprised of state and
local election officials, academic experts on provisional voting and
representatives of voter advocacy organizations. Featured panelists
include the following:
Election Officials
*      Hon. Glenda Hood, Florida Secretary of State
*      Hon. Rebecca Vigil-Giron, New Mexico Secretary of State
*      Hon. J. Kenneth Blackwell, Ohio Secretary of State
*      Mr. Michael Vu, Director, Cuyahoga County Board of Elections (OH)
*      Ms. Cherie Poucher, Director, Wade County Board of Elections (NC)
Academics
*      Professor Dan Tokaji, Moritz College of Law, Ohio State University
*      Mr. John Lott, Resident Scholar, American Enterprise Institute
*      Professor Edward Foley, Moritz College of Law, Ohio State University

*      Mr. John Fund, Editorial Board Member, Wall Street Journal
*      Mr. Miles Rapoport, President, Demos

1. Especially if on list of provisional ballots thrown out in NC?
How about those on this list of provisional ballots that were thrown out in NC?

http://www.democracy-nc.org/improving/OOPcover.html

If I were on that list I'd want to be first in line to talk with Ms. Cherie Poucher.

5. Seems like quite a crook-stacked panel:
* Hon. Glenda Hood, Florida Secretary of State
* Hon. Rebecca Vigil-Giron, New Mexico Secretary of State
* Hon. J. Kenneth Blackwell, Ohio Secretary of State
* Mr. Michael Vu, Director, Cuyahoga County Board of Elections (OH)
(Crooks or just not concerned about fair elections--I think that should be a violation of the law.)

Plus that one "academic," Lott.

One can only wonder at the others.

And what kind of a voter advocacy organization resides within the Wall Street Journal?

4. Mod Mom, would you clarify something?
These panelists aren't the EAC members, are they? What is their relationship to the EAC? I'm not really clear on what the EAC is/does, I guess. A two sentence explanation would help me out here. Are the panelists the ones giving the testimony?

Thanks.

6. EAC was created
to watch over implementation of HAVA and its funding.

They are not these panel members, but have chosen the panels.

Most of HAVA are appointees of *.

My confidence in them is waning severely given that they deem it ethical to spend months investigating Kevin Shelley, while they choose Blackwell to reside on a panel.

I don't know what the panelists will do, but it can't be good.

7. It appears that the EAC is made up of 2 representatives from each state.

One is usually the SOS and I have not discovered how the second is chosen. The Hearing also includes panelists who have been chosen by the EAC to speak at the hearing. No oral public testimony, that might imply we live in a democracy.

Please note: Written testimony can be submitted up until the time of the hearing 1pm EST. I urge all concerned citizens to let the EAC to their concerns regarding Provisional Voting.

THINK ABOUT THIS: In Ohio 21% (In US 35%) of Provisional Ballots were not counted. If you voted provisional there is no way of determining whether your vote actually counted. The majority of provisional ballots were cast in high Dem areas. In my state of Ohio, that meant many of the prov voters stood in line in the cold rain, some up to 10+ hours in order to cast their votes(remember there is supposed to be EQUAL PROTECTION, as defined in the constitution). If they were at a multiple precinct site, which was common, and got into the wrong line (it has been noted that there was a problem with marking, and there were changes in precincts thanks to SOS) they had the option of casting a provisional ballot or going to the correct line (and another wait). If they chose the provisional ballot,IT DID NOT COUNT BECAUSE THEY WERE AT THE WRONG PRECINCT!!!

The spirit of HAVA was, as the name states, Help America Vote. Certain SOS abused their powers by using provisions in HAVA to suppress certain segments of the population. This is UNETHICAL, UNAMERICAN, AND UNLAWFUL! Yet the Dems can't even hold hearings about these unscruptulous SOS's because of the make-up of congress. We need outrage people, we need to demand accountability in our election process. OK time to get off my soapbox so I can get ready to attend thei EAC Hearing!
Fight On!
