AbitibiBowater fights Danny Williams with NAFTA challenge

AbitibiBowater Inc. is launching what it says is the largest free-trade challenge in Canadian history in its efforts to secure financial compensation from Newfoundland and Labrador over what it claims is the province's illegal expropriation of its assets.

The forestry giant's initial estimate of the damages, last year, was about $300-million. But the claim being launched Thursday will go “way beyond” that figure, said a source.

1. Ah yes, the infamous Chapter 11 of NAFTA....
where Corporations have more rights than citizens. If NAFTA remains in place, this is one Chapter that needs to be seriously re-worked, imo, but that won't happen.

3. I am surprised the Harper cabal didn't cave in the negotiations phase...
even though I think Williams is right, they are due compensation only on the expropriated physical assets. It will be interesting to see what part the breach of contract on the part of AbitibiBowater will play in the fight, will the 1905 agreement carry weight in the process.
