Will Wisconsin AG file suit over HCR?
Just saw this on our local Gannett rag...

Van Hollen has no principles.....I suspect he'll try to follow the 12 other states who want HCR declared "unconstitutional". I know enough about writing legislation to know that every piece whether on the local, state or federal level, contains a "severability clause" ...meaning that if any single provision of the law is found to be unconstitutional, then it is "severed" from the main law and the rest of the law stands. Republicans must think we're as stupid as they are.....cheeeese.....

1. I thought I heard on NPR \that in order for Van Hollen to proceed,
Either Doyle or one of the Dem reps has to sign off on it.

3. I heard briefly on tv that either Doyle would have to agree or
2 of the state houses. Since both/all are democratic, we are safe. Just more postering....

2. On tv is looked like the basis of their argurment was that the fed gove can not
compel a citizen to do something....

Wonder how that would have worked with my local draft board a few years back.....

5. Doyle and Decker say no way...
Dear Attorney General Van Hollen:

I have received your request for permission to file an action to contest national health insurance reform. I am denying that request.

This law is an act of Congress, signed by the President of the United States. The lawsuit you suggest is a frivolous and political attempt to thwart the actions of Congress and the law of the country.

National health insurance reform will extend coverage to more than 172,000 Wisconsin residents and will benefit families and small businesses throughout the state.

This year, small business owners will receive tax credits to buy health insurance. Insurance companies will no longer be able to deny coverage to American children because of a pre-existing condition; nor will they be able to drop someone's coverage when they get sick and need it the most.

This law enhances the actions taken by my Administration to make Wisconsin America’s health care leader.

The State of Wisconsin will not enter into litigation intended to deny health care for tens of thousands of residents.

Senate Majority Leader Russ Decker (D-Weston) issued the following statement after Attorney General J.B. Van Hollen:

“I will not authorize the Attorney General to spend scarce state resources to go to bat for insurance companies to continue denying people health care for pre-existing conditions and kick people off of their health care plan when they get sick or make the Medicare donut hole for seniors permanent,” said Decker.
