Sen. Ben Nelson (D-NE) "is leaning toward backing Alito"

Democrats have not ruled out the possibility of a filibuster that could require supporters to post 60 votes in the 100-member chamber. Judiciary Committee Democrat Dianne Feinstein has indicated a filibuster is unlikely and at least one conservative Democrat — Nebraska Sen. Ben Nelson (news, bio, voting record) — is leaning toward backing Alito. Nelson said Thursday that he has seen nothing that would disqualify the nominee.

Democrats peppered Alito about right-to-die cases, presidential authority, affirmative action and ethics on Day 4 of the hearings — and elicited no more personal observations on such issues than they had in previous sessions.

Alito brushed aside attempts by Sen. Charles Schumer (news, bio, voting record), D-N.Y., to get his opinion of a proposal to deny citizenship to U.S.-born children of illegal immigrants.

"I need to apply the same standard that previous nominees have applied, and that's no hints and no previews. I can't opine on them here off the cuff," Alito said.

I don't remember Exxon and Kerry being this centrist.

Sadly, Nelson is just coming off as milquetoast.

7.  I called also
Not just for his Alito vote( How could he vote for that man) but after hearing that he would vote for Alito, I checked his voting record. So I called. Now I will Look for the partition to recall him. I have better Democrats in my neighborhood.

3. There is not any possible way
Nelson will ever go along with a filibuster against Alito. He might vote against the nomination, but it won't really matter, will it?

4. Per his office, he'll vote yes
Also per his office, 90% of his constituents who have contacted him support his decision.
And his office states they do not tally any calls from outside Nebraska, this despite the Alito vote affecting ALL U.S. citizens.
Pretty disgusting.

5. That's not very surprising
There has been an ad campaign to call Nelson and tell him to support the Alito nomination. Like the commercial says, "Will Senator Nelson side with the people of Nebraska or will he side with Ted Kennedy, Hillary Clinton and Howard Dean" - Because Howard Dean is an evil man who wants to kill our children, urinate on our troops and make us all be gay :sarcasm:
