2. She's still up by a few thousand votes, and they are still counting...
...absentee and provisional ballots. It's looking good so far.

Even better, Roger Hedgehog has yet to say her name on his radio show.

7. It's amazing how many voters actually got it right
I can't recall ever seeing such an effective recall in my lifetime, other than the one up in OC where a write-in took a seat in Congress back in the early '70s.

In predictable fashion some group of wingnuts has filed a lawsuit to take Frye off the ballot. Isn't that special. They wait until after the election is over and the votes show that she is winning for them to jump into action.

8. Have you heard about the "lawsuit"...?
San Diego "Fat Cats" politics as usual.
One of Ron Robert's lawyer friends is claiming that the ballot counting should stop and the mayor's race go into a runoff between the two primary winners - without Donna Frye, as she was a write-in.
Seems the city charter sets up the winner of the mayor's race to be between primary winners with no write-ins on the final ballot. In the early 70's, the courts ruled that write-ins were legal as they were the will of the people rather than the will of the good-ole-boy political machine that runs the primaries.
Of course, a certain San Diego connected "ex-mayor" who had been recalled for involvement in a real estate investment Ponzi scheme back in the 1980's is pushing for this lawsuit.

Thursday the 11th, Stacey Taylor had an excellent radio interview with the lawyer making the lawsuit. This guy was a real legal piece of work, and started out on the defensive, trying to twist every comment Stacey and his crew made into a "Lyin' Librul elitist attack on us po', honest, patriotic folks"

From the very beginning - Stacey's opening interview question - (now used in the AM 1360 promo for his show)
"Well, Mr. (XXX), you've been around the block a couple times, so..."
Lawyer:
"Now wait a minute - What do you mean by 'Been around the block'?"

and it went downhill from there.

Another issue that came out in this interview was the linking of the passage of the "Strong Mayor Initiative" to the lawsuit effort. The "Boys in the Backroom" who would back either Roberts or Murphy would not like to see Frye in the mayor's position now that the mayor has been given more power - especially since there's a lot of development issues on the council docket for next year.

Well, if nothing else, many of Donna's supporters have already started talking about a recall initiative should this lawsuit go through and the mayor's race be decided in a runoff between Roberts and Murphy.

Funny how these anti-lawyer and anti-lawsuit wingnuts are whipping them out as fast as you can say, "Mayor Donna Frye".

12. Vote Count Goes On -- Judge Denies Lawsuit
Frye Continues To Hold Slight Lead Over Murphy

SAN DIEGO -- A retired judge denied a request Monday for a temporary restraining order to stop the vote count in the San Diego mayoral race.

The jurist said the plaintiffs should have challenged the write-in candidacy of City Councilwoman Donna Frye prior to the election.

"The voters, I think, are entitled to some due process and some fairness," retired Judge Charles Jones said in his ruling.

Most troubling, however, was the "timing" of the lawsuit and possible other legal challenges to come, he said.

All of the sitting Superior Court judges in San Diego County were recused from ruling on the matter because Mayor Dick Murphy is a former judge.

The plaintiffs, led by Thomas J. McKinney, should have complained about Frye's candidacy before the election, but "sat on their rights," Jones said.

Instead, the judge said, "It was just the sounds of silence.

14. Federal Judge Refuses To Issue Restraining Order To Stop Mayoral Election
SAN DIEGO -- A federal judge Tuesday refused to issue a restraining order to stop the certification of the mayoral election, which write-in candidate Donna Frye is leading, with more votes still to be counted.

But U.S. District Judge Irma Gonzalez said she will convene another hearing Nov. 30 to decide whether to issue a preliminary injunction that would prevent the certification of the election.

Three plaintiffs are also asking for a new election, with Mayor Dick Murphy and county Supervisor Ron Roberts as the only candidates.

Frye leads Murphy by 956 votes with 35,000 provisional ballots still to be counted, officials said. The Registrar of Voters Office is expected to finish the count by the end of the week.

I'm up in the OC, but I come down every other week.

I was actually sitting in the living room (smoking a pipe, no less) with a group of friends when a supporter came up to the open door and handed us some Donna Frye info and asked us to vote for her.

That's a powerful tactic.

All of my friends voted for her (and they were street kids who don't even follow shit--they just thought it was cool/funny to get a hand-delivered name on a paper; sorta like, why not, seems cool?).

It wasn't until later that I realized she was surfer icon (to me anyway, he shaped my first G&S surfboard).

SAN DIEGO Ð Write-in mayoral candidate Donna Frye still trails behind Mayor Dick Murphy in verified votes Ð with Murphy closing the gap on the total number of write-in votes counted so far.

Write-in candidates had 156,158 votes, or 34.51 percent of the vote, according to figures released today by the San Diego County Registrar of Voters Office.

But only 152,155 of the write-in votes have been certified for Frye so far, with others cast for other names or invalidated, and with 13,500 absentee and provisional ballots yet to be counted.

17. It's not looking good right now

The "write in" is barely ahead of Dick Murphy and she has lost at least 1000 votes on the verification of write in issue.

My big question is whether the "write in" choice includes people who filled in the name but not the bubble? From what I hear they are accepting mis-spellings of her name, but are requiring that people filled in that stupid little bubble (which I wouldn't have known to do had a reporter not visited the table I was sitting at to ask questions about write in candidates).

If she falls behind in the actual vote count, I fear that the public will turn against her and the league of women voters suit will fall short.

18. Frye loses if 4,000 disputed ballots aren't counted
The League of Women Voters lost its suit asking that 4,000 ballots with Frye's name written in, but the oval not filled in, be counted. These 4,000 ballots would give Frye a victory. Unfortunately the LWV has decided not to appeal. Unless Frye initiates legal action of her own on Monday, it's over--and the GOP will have stolen another election.
