Clause Allows Some To Opt-Out Of Megan's Law Site

SACRAMENTO, Calif. -- KCRA 3 Investigates has found that thousands of registered sex offenders are disappearing from the Web site that was created to allow Californians easier access to the whereabouts of sex offenders.

In December, Debbie McMillan said she found a registered sex offender living on her street when she logged on to the state's Megan's Law Web site. But McMillan said she was shocked to find that sex offender's information gone from the site when she went back to show it to a friend a few weeks later.

"And I'm like ... that can't be, they're on there for life ... where'd he go?" McMillan said.

KCRA 3 Investigates found that the same legislation that allowed the public Internet access to the names and addresses of sex offenders also contains an opt-out clause allowing many first-time offenders to voluntarily remove their own information from the Internet.

Those allowed to opt-out...
The opt-out clause allows those sex offenders convicted certain child molestations, lewd and lascivious acts with a minor under 14, or sexual battery with restraint, to remove themselves from the Web site.
