Ever thought of the possibility of a hurricane hitting on election day?
Edited on Fri Sep-17-04 06:26 PM by arcos
Hurricane season ends until November 30 and considering how active this season has been, it may be possible. It would be the perfect excuse to postpone the elections, and as a random act of nature it is certainly less controversial than a terrorist attack.

Anyone thought about this possibility?

1. My brain races through possibilities constantly
(wish I could shut it off sometimes) I'm sooo paranoid that I think we could CREATE the hurricane!

They will do ANYTHING within their power to win.

2. Of course I have. I'm from the Gulf Coast.
And there's no provision in the Constitution saying, "Oh by the way.. you can ignore these rules if the weather is bad."

It would require judges to "legislate from the bench" to "find" (*wink wink*) something like this in the Constitution.

7. If we wanted to go by the exact text of the Constitution..
there's no provision in the Constitution saying, "Yeah.. mmkay.. you can ignore that 'Tuesday after the first Monday in November' rule in case of bad weather." We can't make-up rules just because we don't like how the current ones apply to our situation today; that's what amendments are for. "That makes me feel bad" bears no legal weight compared to the very specific election timing instructions outlined in the Constitution.

That would be the letter-of-the-law argument.

On the other hand, an argument could be made that the spirit of the Constitution's right to vote could be leveraged allowing some sort of make-up vote, or extended poll hours or something. Either way, if it goes to our Supreme Court, we're screwed; they're in Bush's back pocket. (Well.. five of them are..)

6. I have an image of Cheney now
Sitting behind a weather machine on Nov. 2, causing tornados, hurricanes and earthquakes in all the swing states. Dr. No strikes again. Mwahahahaha!
