Judge again orders Nader off Florida's ballot

TALLAHASSEE, Fla. (AP) -- Ralph Nader is again off Florida's presidential ballot, at least for now.

Circuit Judge P. Kevin Davey for the second time ordered Wednesday that Nader's name be removed from the November ballot, again finding that the Reform Party isn't a legitimate party under state law. He also ordered that four counties that have already mailed absentee ballots listing Nader send out amended ballots without his name.

His ruling overturns a stay of his order that was automatically issued when Florida Secretary of State Glenda Hood appealed Davey's original ruling. The state Supreme Court has scheduled a Friday hearing on the appeal.

The state Democratic Party is suing to keep Nader off the ballot because, it argues, the Reform Party is no longer a legitimate national party and that Florida election laws requiring minor candidates to qualify by petition or through a nominating convention weren't followed.

Most Democrats and many Republicans agree that Nader's presence on the 2000 ballot as the Green Party candidate cost Al Gore the presidency. President Bush won the state by 537 votes after a recount, giving him the White House.

Hood has said she is fighting Davey's orders "as an honest broker" to protect Florida's elections process by including Nader. She said elections supervisors are "under the gun" because they have to mail absentee ballots by Saturday and first need to get them printed.

A federal judge refused to intercede in the case Tuesday.

4. Gov Jeb and the crime family were sneaking Nader in and saying that
the storm (Ivan) was preventing due rebuttal...so just put him on.

The court said ..."no".

6. What I heard on AAR was:
- Nader sez he has access to ballot because he is Reform Party nominee.
- Fla Dem Party sues, says no you don't, Reform not a real party. They aren't, they have about 50 members and $10.00 in the bank. All their lawyers are coming from the Repukes.
- Circuit court judge in Fla. says Nader off ballot.
- Florida elections officials IGNORE JUDGE, direct counties to put Nader on Ballot.
- Now this notice, which if I am reading correctly is a reiteration of the circuit court ruling, not from the Florida Supremes, which article says will rule on Friday.

prob with all this is that for overseas, absentee ballots need to go out NOW.

7. Judge had ruled Nader shouldn't be on the ballot
but Jeb's supervisor of elections decided to put Nader on the ballot anyway. So, now judge had ruled again Nader shouldn't be on the ballot because he broke a lot of Florida elections rules.

10. this is SO corrupt...man they really are pulling out
anything they can to hinder Kerry's chances...this is sick and scary...honestly...nobody can stop them from lying and cheating their way thru giving FL to *...which I believe regardless of the outcome * will get FL but we have to just work very hard to get OH MN and MO...and WI...let them have FL...LIARS..ugggh that is infuriating

13. There was a temporary injunction to keep Nader off of the FL. ballot
because the reform party is not a "national" party. The repukes could appeal, but Ivan, the storm, was coming to FL. so, Jebbie decided he would issue a stay and let the election director add Nader to the ballot because if Ivan hit FL. they wouldn't have time to appeal the case. Jebbie just told the courts that HE doesn't have to listen to them....thumbed his nose at them. Yesterday, the Dem's election officials filed an appeal with the FL. supreme court. Let's see if they take this to the U.S. supreme court. I wouldn't put it past them. They're getting desperate.

Katherine Harris was actually elected Sec of State. Somehow the Repugs got the people in Florida to agree to make the Sec of State a position appointed by the governor.

This isn't a suggestion from the Circuit Court. It's not a request. It's a COURT ORDER. It is not your choice whether to comply with it or not.

Remember that Florida was ordered to stop out-of-state felons from the voting roles. They did it anyway. No one was EVER prosecuted.
