If Thomas had simply denied the petition, the nutjob filing it could have gone to another justice and then to another and so on until he'd hit them all. And then he'd still have the opportunity to file his petition for ceriorari (what he has filed at this point is not his petition for certiorari, its an emergency petition for stay pending his filing of his certiorari petition). Sending the matter to the full conference gave it the option of treating the stay petition as if it was the certiorari petition itself and to deny it. So at this point, the nutjob is done, over and out. And to the extent that other nutjobs come forward with similar cases, the fact that cert was denied by the full court here means that future petitions can be essentially decided by the justice's law clerks, who take most petitions, divide them up, and make recommendations that are generally summarily followed by the court.

If someone is turned down by own justice but refiles again with another, it's apparently extremely commonplace for that second justice to just go ahead bring it up to the full court. That way the person doesn't keep going from one justice to the next 9 different times.

He handled this exactly the way any other supreme court justice would have. If you're the second justice getting an emergency petition for relief, the standard practice is to refer it to the court so it can be disposed of once and for all.

Actually it doesnt! It does not mean that they have denied anything just because the case wasn't put on todays list. From what I've heard, they may not know until Monday. Heck, Berg hasn't even found out anything yet. He still hasn't had his case listed as denied and his was on December 1st.

The thread was started at 9:33 a.m. today. (I think that's EST.) As of now (3:30 p.m. EST), the thread has 595 contributions. Or, perhaps I should say, 595 posts, because some of them could be considered contributions only in the broadest sense of the word.

As IWantAnyDem reported in #8, some of the Freepers are in denial, hoping that the list of grants of cert that's been released isn't complete, and that Donofrio's case may yet be included. Their hopes can survive until the list of denials is posted, which will probably be on Monday.

Other Freepers are pinning their hopes on one of the other pending lawsuits, such as Alan Keyes's. Still others allude to the possibility of future lawsuits. For example, there's a suggestion that military officers sworn to uphold the Constitution might bring a suit to establish whether they have to obey orders that come from Obama as Commander in Chief.

31. I believe what this means is:

the Supreme Court picked 2 cases, out of the many they had to choose from, to review and the case regarding Obama's birth certificate was rejected as a case they wanted to review because it wasn't one of the two that was issued a writ of certiorari. By doing this, they are saying that the lower court's opinion stands.

A writ of certiorari currently means an order by a higher court directing a lower court to send the record in a given case for review.

I hope this is correct. If not, please advise.

We won't know for sure until Monday if Certiorari was denied in Donofrio's case. But even if it was denied, there's still at least two other cases on the SCOTUS docket.

Berg's lawsuit, which is the birth certificate and kenyan birth one. Souter's hearing that.

Wrotnowski's, which is a clone of Donofrio's (the "natural born" arguement) Denied by Ginsberg, reapplied to Scalia

There may be two more as well, but no info on that.

And at least 15 at the state levels....

55. As much as I hate good old Clarence Thomas he did the right thing

he essentially stopped the stupid thing from moving to justice to justice. Per Jeffrey Toobin on CNN, this is why Thomas did this. I can't believe he did something right but I still dislike him immensely. However, Scalia (get over it, about the 2000 election debacle) and Alito (holding grudges against Biden from the questions at his hearing) are worse.
