The supreme court will be looking at Obama birth certificate on Friday.. and it makes me so mad

Because they are going to dismiss all the freepers and their hanger ons and the nonsense they have been focusing on. It will be put to rest, dammit. This has just been the gift that kept on giving. They were making such assess out of themselves on a daily basis..

The focus on that birth certificate has kept those looney tunes out of our hair. Now we are going to have to come up with something else to feed them, oh I don't know. Maybe he eats little kittens for lunch. Something, to keep them occupied over there.

4. someone sent me an email saying they were going to dismiss
an appeal being made to them.. ~sigh~.. just when they (berg and his ilk) were getting as loopy as they can get, and their focus was working them up to a mouth foam, they could pull the rug out from all our entertainment. :rofl:

18. Nope, not Biden....
The cultists believe Biden has contaminated himself being on the Obama/Biden ticket. What happens next depends on which group of nutbars you listen to:

1) The PUMAs believe that the Obama/Biden ticket will get decertified, but the Democratic party will still be the winner. Party officials will then select the one who got the second-most votes, i.e. Sen. Hillary Clinton, who will then select her own VP, (usually McCain as a unity ticket).

2) The Freepers believe that the Obama/Biden ticket will get decertified, and all electoral votes will by default go to McCain/Palin. Result, McCain/Palin in a landslide.

Section 3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

There's no question over Biden qualifying, so Congress doesn't get to move to the step of declaring who shall act as president. The electors will have to choose Obama as president and Biden as VP. And given that the 15th specifies that the VP doesn't just act as president, but becomes president, I don't see what even the most deluded could build a case for someone other than Biden becoming president on.

31. Their arguement....
...is that if the DMC ticket is decertified, it's the ENTIRE ticket, not just Obama. In which case, goes their flawed logic, it goes to the person who came in second in the primaries, (the PUMA arguement), or the ticket that came in second in the GE (Freepers)

They both do cite the "declaring who shall then act as President" part, the PUMAs claiming the Democratic majorities in both houses will select Sen. Clinton, and the Freepers saying they'll select the ones that the most people voted for after Obama/Biden.

Don't forget, one of the things all of these lawsuits have in common is a demand not to allow the electors to cast their ballots until their demands are met. In two of the cases, the lawsuits were resubmitted to Thomas and Scalia after Souter and Ginsberg rejected them, so it's obvious they're shopping for a sympathetic venue.

Yeah, I know, it doesn't make sense to me either.

1. Obama's BC is not at issue before SCOTUS, and they will not be looking at his BC this Friday.

Berg has applied to SCOTUS for a for Writ of Certiorari which is an application for SCOTUS to hear the case... Berg's case was dismissed, and he is appealing to SCOTUS to overturn the dismissal.

2. Obama's BC is not at issue before SCOTUS, and they will not be looking at his BC this Friday.

The best Berg could hope for is that SCOTUS grants his request for a Writ of Certiorari and reverses the dismissal of his case which sends the suit back to the trial court for a hearing on the merits or summary judgment.

14. Here's their version of the Obama birth -
he was born in Kenya and his grandmother had his mother return to the U.S. with him immediately so they could register his birth in Hawaii which would make him an American. According to freeper legend, Toot registered the birth with the Hawaiian authorities and that's why - really bizarro freeper here - Toot had to die the day before the election so she would never have to fess up that Barack was born in Africa. The missing link would be, of course, the fact even infants must have a passport to travel, but that's a mere technicality in freeperville.

16. And you forgot.....
....even if he was born in Hawaii, he still can't be president because:

1) When his mother married Lolo Soetoro and moved to Indonesia, both he and his mother lost their US citizenship (Berg)

2) It doesn't matter because his father wasn't a US citizen, and therefore he is not a "Natural Born" US citizen, but has divided loyalties due to having UK/Kenyan citizenship at birth (Donofrio)

Those are the two main arguements if the COLB nonsense gets dismissed.

Oh, and there are now five lawsuits at the SCOTUS level. One's a clone of the Donofrio case, one was filed directly from Texas, and the last is from a New Yorker with an.....interesting legal history.

..and it doesn't matter if his parents were citizens or not. If you're born in the U.S., you are a citizen.

And actually the Nationality Act of 1940, (which Berg misleadingly cites) and the Nationality Act of 1952 states quite clearly that no actions of a parent can deprive minor US citizen of that citizenship.

“A person who is a national of the United States, whether by birth or naturalization, shall lose his nationality by: (a) Obtaining naturalization in a foreign state, either upon his own application or through the naturalization of a parent having legal custody of such person: Provided, however, That nationality not be lost as the result of the naturalization of a parent unless and until the child shall have attained the age of twenty-three years without acquiring permanent residence in the United States:.........”

That Act, at Section 407 said:

“A person having American nationality, who is a minor and is residing in a foreign state with or under the legal custody of a parent who loses American nationality under section 404 of this Act, shall at the same time lose his American nationality if such minor has or acquires the nationality of such foreign state: Provided, That, in such case, American nationality shall not be lost as the result of loss of American nationality by the parent unless and until the child attains the age of twenty-three years without having acquired permanent residence in the United States.”


But little things like laws, reality, or truth don't matter to these cultists.

The political content of Free Republic is "All Birth Certificate, All The Time".

They will be in conference over the Donofrio case.

They will reject the case on teh grounds that no court in the United States has jurisdiction over the eligibility of any candidate to be president. That power resides with teh several states before the electors are chosen and with the United States Congress after the electors are chosen.

Teh SCOTUS has no jurisdiction whatsoever.

The Supreme Court is apparently afraid of riots and civil unrest, so "the fix" is already in.

At least some of them are savvy enough to put together the groundwork for the next round of "why this stupid theory didn't fly".

The constitution is very clear. The several states have standing to determine eligibility all the way up until electors are chosen by the several states. After the electors cast their ballots, the Congress in joint session has standing to determine eligibility and have even codified a prcedure whereby an objection on eligibility can be raised (3 U.S.C 15).

Admittedly, all 50 states have granted standing to the people via the electoral process. The results of that test of eligibility was a resounding affirmation of Obama's eligibility.
