Obama not eligible to run for president?
Someone de-bunk this for me please?

My boyfriend's father said he's not eligible because he was not born in the US and his mother was under 19 when she had him.

I would imagine if this were the case he would not have gotten this far? Links would be nice. Thank you! :)

For her son to be a US citizen, IF he had been born in another country.

HOWEVER HE WAS BORN IN THE U.S. - this is what the freepers fail to understand.

Born in the U.S., you are a U.S. citizen regardless of your mother's age. Regardless, even of your mother's citizenship - even the children of illegal aliens born in the U.S. are U.S. citizens at birth - something these same morans whine about whenever they get the chance!

That's no-shit true.

Barack Obama was born in Hawaii, the 50th state, in 1961. After Hawaii had been a state for about 2 years.

Tell them the Panama Canal Zone is not a state, or even territory or protectorate, of the U.S.

79. Here:
Senator Obama was born on August 4th, 1961, in Hawaii to Barack Obama, Sr. and Ann Dunham. He graduated from Columbia University in 1983, and moved to Chicago in 1985 to work for a church-based group seeking to improve living conditions in poor neighborhoods plagued with crime and high unemployment. In 1991, Senator Obama graduated from Harvard Law School where he was the first African American president of the Harvard Law Review.

Age of his mother is a non-issue. Age for Presidency is and he qualifies.

I do have an issue with McLame being born in Panama in a hospital that wasn't built until 5 years after he was born. Yes, both parents were American citizens and his father was military, but all reports I have seen have said the actual hospital, on a military base, where he was supposedly born, was not in existance at that time.

115. Have to be "natural born" citizen, not just a citizen
Edited on Sun Oct-19-08 11:07 PM by JoeIsOneOfUs
Which I think is why Alexander Hamilton never ran for President (born in Caribbean, not citizen long enough before Constitution). Also why Arnold Schwarzenegger can't run for Pres.

"Natural born" is usually interpreted to mean in U.S. state or territory.

http://www.archives.gov/exhibits/charters/constitution_transcript.html

"No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States."

I wasn't taught this in high school, so I've learned something. Though I wouldn't agree "It makes no fucking difference WHERE one is born." - If you're not born in the U.S., your parents' citizenship history comes into play, while if you're born here, your parents' info doesn't matter.

What was really exciting was the scroll was found with a pile of T.Rex skeletal remains. Maybe Sarah is right after all. Who knew!

48. McCain wasn't born in the US, Obama was.
It is still an open question as to whether John McCain is eligible as there is no precedence for such a thing. He was born prior to the law that passed that recognized those born in that area as Natural Born Americans. The law had no ratroactive clause to it.

McCain’s Canal Zone Birth Prompts Queries About Whether That Rules Him Out

To date, no American to take the presidential oath has had an official birthplace outside the 50 states.

“There are powerful arguments that Senator McCain or anyone else in this position is constitutionally qualified, but there is certainly no precedent,” said Sarah H. Duggin, an associate professor of law at Catholic University who has studied the issue extensively. “It is not a slam-dunk situation.”

A Hint of New Life to a McCain Birth Issue
July 11, 2008

In the most detailed examination yet of Senator John McCain’s eligibility to be president, a law professor at the University of Arizona has concluded that neither Mr. McCain’s birth in 1936 in the Panama Canal Zone nor the fact that his parents were American citizens is enough to satisfy the constitutional requirement that the president must be a “natural-born citizen.”

84. Actually McCain wasn't even born in the canal zone
He was born in Colon, Panama, which is near the east end of the canal but not inside the canal zone. The same was true of Panama City, near the west end of the canal.

Reason why is obvious.... Panama would not want to concede two cities to US occupation, nor was it necessary to occupy the cities themselves in order to operate and maintain the canal.

So McCain was NOT born on "American soil" by any stretch of the term. He was born to American citizens, so he is legitimately a US citizen himself. But the term "natural born citizen" is certainly disputable.

125. I did some checking...
Here's what this whole "mother's age" thingamajig is about:

Before 1934, if you were born outside of the US and your mother was a natural-born US citizen of ANY age, the mere fact that she was a citizen transfers her 'natural-born' status to you. (This is how McCain can get away with being born in Panama. It was before 1934, and BOTH parents were natural-born AND he was born in a US military hospital.)

AFTER 1934 (when the law changed), if you were born outside of the US and your mother WAS 19 YEARS OF AGE by the time you were born, then her 'natural-born' citizenship status transferred to you.

What the freeper's crazy theory is saying is that Obama wasn't born in Hawaii, but rather Kenya. They say they have evidence from his paternal grandmother who was supposedly there to witness the birth. They also are saying that Obama's mother's natural-born status did NOT transfer to him because she was 18 at the time of his birth. Ergo, he is NOT a natural-born citizen, and therefore ineligible to run for the Presidency.

Question 1: What's grandma's name? Question 2: If this true (and therefore generating a constitutional crisis), why haven't we seen this on the national news? You would THINK that if it were this important, SOMEONE would've gotten a hold of it. Since nmo one has, that means they're not worried about it, and neither should we.

This is just grasping at straws.

Tell the "dude" that if he is so desperate to find reasons to support John McCain, as this is just a ludicrious and many times debunked clalim, that perhaps he ought to start wondering why he is so waivering in his support of John McCain. If he supported so strongly the policies put forth by McCain/Palin he would be arguing those points rather than throwing out ridiculous (and already proved factless) claims - so get him to dwell for a moment in why he is so uncertain about the policies being pushed by McCain Palin.

121. McCain was born in Panama while Obama was born in the state of Hawaii
Article II of the US Constitution spells out the requirements for the Presidency:

No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States.

126. Some people would say
that your boyfriends father is a fucking idiot.

Those people would be correct.

Jebus.

Obama is an American - Ask your retrograde moran boyfriends father if he understands that Hawaii has been a state since 1959. Prior to that Hawaii was a U.S. Territory.

His mother could have been 15 and it would not matter her age has zero bearing upon Obama's eligibility.

The Democrats are not stupid enough to allow a non-American to run for the office.

After you tell the idiot this, please feel free to slap him in the head with a ham hock.

You needed to ask us to help you debunk this?

although in mccain's case, it's a really really really silly technicality.

132. Use this response about McCain ... trust me, its fun!!!
October surprise!!!!

This story could break any day now.

It is rumored that McCain's mother, while pregnant, left the US base where she lived in Panama to go shopping.

She became tired and stopped in a cafe for lunch. Suddenly she went into labor. The cafe workers took her in the back and helped deliver little John McCain. They called him EL Guapo.

After the birth, McCain's mother was unable to travel. So one of the cafe workers let her (and John) stay in her tiny home overnight until she was ready to go back to the base.

The next day, the cafe workers took John and his mother back to the base.

The doctors at the base, unsure what to do, simply wrote the birth certificate as if John McCain had been born on the day they returned to the base.

Technically ... a story like this might mean that John McCain is not be an American citizen. He might actually be Panamanian.

Some argue that John McCain co-authored the Amnesty bill as a way to "give back" to those cafe workers who helped his mother.

McCain has not denied this story. Which make one wonder what he might be hiding.

He was born on a base in Panama.

145. was Obama's mom ever in Kenya?

I can't find any reference to Obama's mother ever traveling to Kenya. Does anyone know if she ever went there? Because if she was never there, how could she have given birth there?

I recently got a blast email saying that a child born in the U.S. of an under-age mother is not a citizen. (And which country would all the kids born of pregnant American teens be citizens of? Huh?)

Age has zero to do with citizenship and Obama was born in Hawaii. Even if he had been born in Kenya he would still be a US citizen as his mother was a US citizen.

I watched this theory develop and play out over the summer on FreeRepublic...its basically TOO HARD to explain how they came to their conclusions.

They have no evidence - just jpg scans of documents. Everything else is basically stuff they made up or were to too dumb to understand.

156. How old are you? Have you taken high school civics yet?
Edited on Mon Oct-20-08 11:08 AM by yardwork
When you take high school civics, you will learn that there are two requirements for presidents in the U.S. Constitution. Neither of them has anything to do with the age of the mother. Apparently your boyfriend's father failed high school civics.

P.S. Obama was born in Hawaii. He has released his birth certificate. Apparently some people aren't aware that Hawaii is one of the fifty states. They too probably failed high school civics.

P.P.S. If your boyfriend didn't know this, then he too should brush up on the Constitution. And, if I were you I'd check basic facts before making a fool of myself by posting ignorant right-wing smears on a public board, but that's just me...
