I recall -- high school AP government class? -- that is still a federal law (or was in the mid 80s), passed during the Civil War, that made efforts for secession tantamount to treason. That is to say, secessionists are considered under law to be levying war against the United States and/or adhering to and giving aid and comfort to those who are levying war against the United States (the definition of treason given in Article III, Section 3 of the US Constitution.)

This law has not been enforced as there have been no serious secessionist movements since the end of the Civil War. That does not mean it is not still a criminal offense.

I would be curious to hear from legal experts as to whether we can legitimately call the Alaskan Independence Party a traitorous conspiracy. If so, and given that Palin apparently still has close ties to this group....

Such has been the excuse used against gay men (and sometimes gay women) with regards to sodomy laws. While such laws were enforced only very rarely, the simple fact that existed they was enough (in those states that had such laws) to automatically brand all gay people as criminals. Thus, gay people could be denied employment, rental contracts, bank loans, etc. or have existing employment, rental contracts, etc. legally withdrawn with no notice or warning under laws that allow such things with regards to criminals. This is very well established case law in Texas, Georgia, Louisiana and Michigan (that I know of) and, until the Lawrence decision which invalidated all sodomy laws, has been repeatedly upheld in federal courts.

If the law I mentioned still exists, and the AIP meets those standards, then all people involved in it -- including Rachel Palin -- are traitors to the United States. Whether the federal government will prosecute them as traitors is entirely irrelevant and would not make those involved in it -- such as Rachel Palin -- any less a traitor. Saying this would not be dirty politics, but the act of a loyal and patriotic American citizen.
