Dear Mr. French:

The Oregon State Bar has received the enclosed correspondence and e-mails from numerous sources. Pursuant to Bar Rule of Procedure 2.5(a), the Client Assistance Office reviews all inquiries regarding lawyer conduct to determine whether there is credible evidence of misconduct. Some of these concerns may implicate the provisions of DR 1-102(A)(1) and DR 1-102(A)(3).

Many of the inquiries contend that your affidavit and the advertisement make representations that are misleading. Please explain what role you played in preparing and producing the affidavit and the advertisement, and your intent in doing so.

In order for me to make a fair and informed analysis, I would like to have your account of the matter on or before September 9, 2004. I am able to grant an extension of the time to respond for good cause if requested before the deadline.

A copy of your response will be sent to the inquiring parties. All material submitted by the parties in the course of this investigation is public record and both parties will receive copies.

After I review all documentation and information gathered in this matter, if I feel that further investigation is warranted or that there is credible evidence of a violation of the disciplinary rules, the matter will be referred to Disciplinary Counsel’s Office for further handling pursuant to BR 2.5(a)(2). Your failure to respond to this request will also result in the matter being referred to Disciplinary Counsel’s Office.

5. Oh yeah, baby!
Don't mess with the Oregon State Bar. There are many, many legitimate gripes to be made about the legal profession. But in Oregon, from 25 years of personal observation and experience of working in law offices, I will say that the Oregon State Bar maintains the very highest standards of professionalism and ethics.

I have every confidence that Mr. French's situation will be thoroughly and fairly investigated. If he still has his bar card when this is over, it will not be because of cronyism or corruption at the Bar.

As an officer of the court and a member of the bar, Mr. French should have known better than to attest to events he could not possibly have witnessed, then fall back on second-hand accounts after the fact. I would love to see his actual affidavit. He can answer to charges as most people must, with evidence. It serves him right after circumventing the usual - and ethical - modes of evidence in order to engage in a smear of a fellow veteran. Eat an ethics investigation, bee-atch. Eat it.

As a proviso for lurking freepers: Mr. french has every right to speak his mind freely. He does not, however, have a right to fly in the face of every rule of conduct in the deliverance of a sworn affidavit - and he does not have an inherent right to either practice as a lawyer, nor be a member of the Oregon State Bar. these privileges are contingent on his capacity to behave within a given code of conduct. If he violates that code, his privileges can be revoked. I think only a thorough investigation will determine whether he violated that code in attesting to events in an affidavit which he could not possibly have witnessed. You all agree, right?

13. don't worry about the freepers, they HATE lying under oath
they will all most certainly agree Mr. French should be impeached, disbarred, and run out of town on a rail. As to his affiar, the freepers will pay $70 million to have every detail investigated and published and televise his deposition.

Good for the goose...

14. LOL: I'd forgotten that Mr. French's case has all the elements that push
Freepers to vitriol: Lying in a sworn affidavit, having an affair with a secretary (freepers get worked up about sexual affairs in the office, especially when there are asymmetrical power relations!). Yes. You're quite right. The freepers will themselves condemn Mr. French and urge that he be disbarred, since they are the height of consistency, if nothing else...:evilgrin:
