So who get's to prosecute Thurlow..military or civilain??
He's either lied to the military in his report that earned him the Bronze Star or he lied in his affidavit the other day claiming Kerry wasn't under fire at the same time he was earning HIS Bronze Star..

He broke no civilian criminal law(s) with his 'Swift Boat vets' affidavit, IMO.

Doesn't that open him up to a perjury charge?

Either way, I'd say civilian or not at all. If we say this chucklehead lied to the military for his medal, we're inadvertantly saying Kerry lied too.

Perjury has a specific legal definition, and in order for it to be a prosecutable offense, the alleged perjurious 'utterance' must have been made in connection with a civil or criminal legal proceeding, or in connection with sworn testimony before a legislative body; furthermore, the alleged perjurious utterance must have been material to a question of fact in the case.

The elements necessary to prosecute a person for filing a false affidavit is that the affidavit be false and be sworn before an officer of the court...



Obviously the Swift Boat liars thought having sworn affidavits would bolster the facts in their book...

On edit: If he insists that Kerry didn't deserve one, he didn't deserve his either. He's been caught with his pants down, IMHO. This whole thing is so sleezy and disgusting.

I think people are over reacting here.
Surprise there is a contradiction in a story that is 30+ years old.

Who filed the after action report? The same guy who filed the affidavit?

Still it is a good thing that someone is (finally) going over the "boat people" with a fine tooth comb.

Only two parties have been wronged by the dislosure of this moran's lies.

One, obviously, is John Kerry...whose record now stands tarnished due to his lie and could seek restitution. However, this would mean a long civil court case and would drag this sorrid slime job on for months if not years to come.

The other, ironically, is the publisher of this slime. The affadavit was signed between Thurlow and the publisher, and thus there's your breach of contract. Think O'Neill & company will sue?

Again, where was this information the moment this clown opened his pie hole? I could have shut this whole slime operation down and turned the tables on who was behind this.

Lies travel around the world before the truth gets dressed...here's proof.

12. Kerry probably couldn't.
He's a public figure, and the laws of defamation are applied differently to public figures than they are to 'ordinary', private citizens.
