Does Edwards still qualify for Federal Public Funding?

Does Edwards still qualify for Federal Public Funding?
According to the link provided the spending limit for a candidate in the primary election receiving public funding is $42,050,000. But, according to Edwards' May FEC filing his total spending so far has been $55,821,961.00 and he still has to pay $1,409,203 in loans that will add to that total.

Does he still qualify for public funding? If not, will he have to give back the money he's already received and be that much in the hole?
