how long must someone be out of active military duty before being eligible for Secretary of Defense?

Section 113. Secretary of Defense

(a) There is a Secretary of Defense, who is the head of the
Department of Defense, appointed from civilian life by the
President, by and with the advice and consent of the Senate. A
person may not be appointed as Secretary of Defense within 10 years
after relief from active duty as a commissioned officer of a
regular component of an armed force.

3. So, anticipating the next question.....
No, Wes Clark would not yet be eligible. He retired in 2000, so January 2009 wouldn't work. Though if President Kucinich wanted to appoint him for his second term in 2012, that could happen :)

6. But you know he would change the name of the position
to "Secretary of Peace", right?

Of course that's a good thing. Except for the "defense" contractors.
