Leslie Southwick has been nominated for a lifetime judgeship on the Fifth Circuit Court of Appeals. He is a former Mississippi State Court judge and Trent Lott protege with a terrible record. Tomorrow morning, the Senate votes on whether to filibuster this nomination. If the filibuster fails, there is no doubt he will be confirmed since more than 50 Senators have already said they would vote for him.

Highlights (lowlights) of Southwick's Record
1) Southwick joined an opinion reinstating a white employee who had been fired for calling an African-American coworker "a good ole ni**er." He concurred in the decision that found that use of the racial slur "was not motivated out of racial hatred or racial animositydirected toward a particular co-worker or toward Blacks in general."
2) He routinely ruled against defense claims that prosecutors rejected black jurors because of their race but, on the other hand, more often than note upheld allegations of race discrimination against white jurors.
3) Southwick once ruled that a child should be removed from the custody of her bisexual mother, joining an opinion that argued that "choice" to engage in homosexuality comes with consequences, up to and including the consideration of "the homosexual lifestyle" as a determining factor in child custody cases.
4) He ruled against workers and consumers in 89% of his cases.
This is not even a close call - Leslie Southwick should NOT be confirmed to a lifetime appointment on the Fifth Circuit.
