Duncan regrets flag-desecration incident, is investigating

Buncombe County Sheriff Van Duncan told the Xpress this afternoon that he regrets the turn of events surrounding the July 25 arrests of activists Mark and Deborah Kuhn on flag-desecration charges. Meanwhile, Xpress has learned the flag law was declared unconstitutional in a 1971 N.C. district court ruling.

“I regret that it happened this way — we’re not trying to enforce that statute,” Duncan said. “We had internal affairs investigators in the neighborhood today. I’ve met with the Kuhns personally. We’re talking to the District Attorney, we’re talking to their attorney and we’re trying to get this resolved.”

“We would normally not have handled the situation that way,” Duncan said. “We’re looking into it right now and trying to see how we can proceed to make sure an incident like this doesn’t happen again.”

Meanwhile, today Xpress learned that, in addition to U.S. Supreme Court decisions ruling that political uses of the flag are protected speech, North Carolina’s statute was declared unconstitutional in a 1971 ruling by the District Court of Western North Carolina. “Enacted during a period of national chauvinistic fervor, it is an uncommonly bad statute,” Circuit Judge James Craven Jr. wrote in the ruling. “Despite our respect, and indeed love, for these symbols of state and nation, we are compelled to hold the statute unconstitutional.”

Yet the local “News” rag still advocates people turning in their neighbors to the Sheriffs dept:

State law on desecration of the U.S. flag
It shall be unlawful for any person willfully and knowingly to cast contempt upon any flag of the United States or upon any flag of North Carolina by public acts of physical contact including, but not limited to, mutilation, defiling, defacing or trampling. Any person violating this section shall be deemed guilty of a Class 2 misdemeanor.

• To report flag desecrations, people can call the Buncombe County Sheriff’s Office at 255-5000."

It is still there nearly 6 hours after I called the editor of the paper who stated he wasn’t aware it was there, and would have it removed at once.

4. Yup.
There is a lot more to the story of Ossifer Scarbourough than has been reported. Yet. Wouldn't surprise me in the least if a little digging into the guy discovers interesting things.

B. Substantial cash settlement.

Edit: and I don't mean a secret one, either. Put it on the front page for all to see, with the proceeds to go to the organizations of the victims' choice - ACLU, etc.

Also to go on the front page: the picture of * autographing the flag, and the picture of him walking on it last 9/11. Someone dig those up, please.

I thought Nifong was unique in NC. I can see I was wrong.

hillbilly is a very classist term meant to denigrate an entire population in order for industrialists to make way for exploitation of the land and people of Appalachia.

Its legacy can be seen even today in mountaintop removal.

Once the Democratic party and my beloved lefties can learn to stop the hatred and denigration of poor working class white folks, the electoral landslides in our favor begin.

I'm no angel either. Raised in Eastern, Kentucky, I've had a love/hate relationship with my hillbilly heritage. The older I get though, I realize how truly lucky I am to have grown up in a unique culture such as mine.

I live in the Appalachians and love the people, their culture and land more then you know. Trust me, they proudly call themselves hillbillies.

I just like seeing Hillbilly used as a fantastical positive reference. Sadly though, it's used as a term to demonize.

Hell, people would pay big money to see what I can for free on Sunday afternoons: Red Allen's boy Ronnie leading the bluegrass jam at the Stockyards Inn every Sunday afternoon at the Stockyards Inn in Dayton, Ohio - the urban Appalachian Babylon of the United States.

9. Three more DISTRESS flags on same road.
On Brevard Rd., here in Asheville, three neighbors have hung inverted US flags in a show of support. Also a tombstone reading "RIP Habeas Corpus" and a poster of W labeled LIAR are on display. The Kuhn's have replaced their flag with a banner of John Lennon flashing the peace sign.

I heard that the Kuhns are not going to sue IF the deputy is fired.

11. Why is it that I can remember the early 90s
When Poppy Bush was ignoring every problem in the country so he could declare himself the anti-flag burning president, and the Supreme Court smacking him down, but law enforcement officers can't? This isn't new. Every few years there's another story of someone being arrested for flag desecration. It's incredibly legal to do whatever you want to a flag - the Supreme Court said so. That means it trumps whatever redneck statute put into a state's law book that purports to say otherwise.

13. It was more then flag desecration

By the accounts of the couple and of an independent witness, the sheriffs deputy kicked the door of the Kuhn's (AFTER they complied with his order to remove the flag), busted the window of the residence to reach in and unlock the deadbolt before assaulting the residents of the home.

The deputy claims otherwise.

subject: Your newspaper's call for vigilantism
