Why can't bin Laden's driver be tried for conspiracy in a regular court?

Why can't bin Laden's driver be tried for conspiracy in a regular court?
I still can't get my mind around it.

What possible state secrets could be revealed over this case? The guy was picked up in Iraq, not because they searched his bank records, listened in on his cell phone or any of the other unConstitutional acts that Shrub got his pet AG to approve that they don't want us to find out about.

So how could they possibly argue that they need to have a military tribunal to protect some big secret?





(maybe, once again, they just don't have any evidence but don't want the public to know just how badly they are handling things)

3. I don't think he can be successfully prosecuted in ANY legitimate court
due to the evidence against him being "tainted". Tainted because of torture.
Same situation with Khalid Sheik Mohammad, a top al-Qaeda operative in planning 9/11.

Because of the torture factor, their cases would be thrown out, or dissected big-time by a halfway decent defense attorney, or the convictions would be overturned on appeal.
