1. close call...both First and Fourth are taking a pounding...
Fourth getting somewhat worse in view of Bush's decision to ignore it all together.

5. one and four
I chose the first amendment because it keeps expression and the flow of information down. Of course, the search and seizure provisions are at risk too. Six is important, too, as the hunger strikes at Gitmo are proving. And then there's eight.... Sheesh, it might be easier to ask whether any part of the Constitution isn't at risk!

* Amendment 4 - Search and Seizure
* Amendment 5 - Trial and Punishment, Compensation for Takings

8. right to property (5th) took a big hit in Kelo, and the right to
be free of unreasonable searches is under attack big time, but the assault on the right to bear arms is more coordinated and unrelenting than any of the other attacks .

The Bush administration rendered the 4th amendment, flying it by private jet to a prison in Egypt, where it's waterboarded.

Without that one, Clinton would probably still be president, the economy would be booming, everyone who wants to go to college could, we'd have invested in new energy technologies, signed Kyoto, not be mortgaged to China, Saddam would still be contained, we'd have foiled the 9/11 plot, Rush L would have actually exploded in a foul spray of bile during a Hillary rant, and foxnews would by now be renamed and running old movies, with Hannity and OReilly doing a 2-man show in the Gatlin Brothers Thee-a-ter in Branson, Missouri, although Rupert Murdoch would still be a global porn czar
