Alito voted for pro-abortion stance in 3 of 4 cases
Interesting, to say the least, especially the 1997 case.

• A 1991 challenge to a Pennsylvania law requiring married women to notify their husbands before seeking an abortion. The court struck down the restriction. Alito dissented.

• A 1995 challenge to a Pennsylvania law that required women seeking to use Medicaid funds to abort a pregnancy resulting from rape or incest to report the incident to law enforcement officials and identify the offender. Alito provided the decisive vote striking down the abortion restriction.

• A 1997 challenge to a New Jersey law that prevents parents from suing for damages on behalf of the wrongful death of a fetus. Alito ruled that the Constitution does not afford protection to the unborn.

• A 2000 challenge to New Jersey's ban on so-called partial-birth abortions. Alito struck down the law based on a recent Supreme Court decision.

Thanks for the info.

Maybe the David Souter effect will play here as well.

I don't want to take that chance, however. I want to defeat Alito and stick another nail in Bush's coffin.

For example:

JOSH: Sir, if the House successfully overrides the veto, we're gonna look weak.

BARTLET: If the House successfully overrides the veto, we are weak.

The West Wing, Season 3, Episode 4, "On The Day Before."

The only thing that looks weaker than a Supreme Court nomination withdrawl is a Supreme Court nomination getting shot down like the Luftwaffe over Britain in 1940.

4. The gotcha that I've always seen
in this scenario when right-wing nut cases say they will (or do) 'uphold the law' is... A lower court judge may vote to uphold a law, including abortion, because it is 'constitutional.'

However, and here's the 'gotcha,' if that same person were on the Supreme Court, and that same law came before their court for a ruling, that right-wing nut case would clearly vote to say that law was unconstitutional.

See how that works?

the thing supposedly binding Supreme Court justices is stare decisis, which conservatives say is sacred.

6. well. uncomfortable with this guy, but he must be a pragmatist
of some kind because, while rhetorically seeming to support right-to-life activities, he has ruled even for PARTIAL BIRTH abortion.
I would think he must have at least some token opposition from Right to Life people over that. There must be some distrust from their side. Yet, I'm not picking up any. Has anyone else?
