This is not to disparage Harriet Miers. From all accounts, she is a gracious lady who has spent decades in the law, and served ably as Bush's lawyer in Texas and, for a year, as White House counsel.

But her qualifications for the Supreme Court are nonexistent. She is not a brilliant jurist – indeed, has never been a judge. She is not a scholar of the law. Researchers are hard-pressed to dig up an opinion. She has not had a brilliant career in politics, the academy, the corporate world or the public forum. Were she not a friend of Bush, and female, she would never have even been considered.

What commended her to the White House, in the phrase of the hour, is that she "has no paper trail." So far as one can see, this is Harriet Miers' principal qualification for the U.S. Supreme Court.

What is depressing here is not what the nomination tells us of her, but what it tells us of the president who appointed her. For in selecting her, Bush capitulated to the diversity-mongers, used a critical Supreme Court seat to reward a crony and revealed that he lacks the desire to engage the Senate in fierce combat to carry out his now-suspect commitment to remake the court in the image of Scalia and Thomas. In picking her, Bush ran from a fight. The conservative movement has been had – and not for the first time by a president by the name of Bush.

1. Ed Schultz calls it
a "head fake."

I'm not sure if the Repugs are just going along with it, or if they're actually fooled as well. What's important is whether or not the Dems are being fooled.

3. Yeah, so what's your point, Mr. Buchanan?
Bush has already demonstrated that he'll let people die horribly in a natural disaster just so that one of his buddies' buddies can put "Director of FEMA" on his resume. Bush has no respect for the conventions and structures of government, and has gleefully knocked many of them down in the last five years through a series of not-quite-illegal executive orders, corner cuts on the way things are usually done, and a total freeze out of any dissent or even contradiction.

And you, Mr. Buchanan, and your "conservative" pals who dominate the nation's airwaves haven't said a word against it. Indeed, your undisguised gloating at many of the Bush administration's maneuvers makes your current dis-ease with the Miers nomination sound like so much empty noise and even more meaningless prattle.

This is your monster, you created him and foisted him upon our once-great country. Sucks now that the horror is finally making its way into your heretofore sealed conclave of privilege, doesn't it?

4. After listening to NPR today..
... a report on this nomination and the backlash from the right, I've changed my mind.

They really don't like this nomination. Interviews with various RW leaders convinced me. They use words like cronyism, unqualified, etc - not the kind of rhetoric they would be using if they were feigning dissapointment.

I really think the RW thought that this was to be their payoff, they wanted a solidly, overtly anti-Roe nomination and that is not what they got.

They are pissed.

8. But the right doesn't know that for sure, that's why they're objecting:
They KNOW she's an "unqualified sycophantic crony" -- they just want to know for sure that she's a "dogmatic extremist" one!

She'll do what Scalia tells her to do. So I can't really understand why the RW hates her so much.

That woman has visions of glory overtaking her JUDGMENT. She is clearly not qualified, and should know that, yet she accepted "the most brilliant man she has even known"'s nomination for the critical position. Hubris? check Lack of character? check
