Clark Caught in Bind by (Uniform Code of Military Justice) UCMJ !
+++The Bush Admin wouldn't hesitate for a moment to play dirty using this little ditty. Even if it got thrown out it could tie up Clark for years---IN A COURTS MARTIAL!++++

Uniform Code of Military Justice
Section 802 Article 2 Persons Subject To This Charter

#4 Retired members of a regular component of the armed forces who are entitled to pay.

Section 888 Article 88 Contempt Toward Officials

Any COMMISSIONED officeer who uses contemptuous words against the PRESIDENT, the VICE-PRESIDENT, CONGRESS, the SECRETARY OF DEFENSE, the SECRETARY OF A MILITARY DEPARTMENT, the SECERTARY OF TRANSPORTATION, or the GOVERNOR or LEGISLATURE of any State, Territory, Commonwealth or possession in which he is on duty or present shall be punished as a court-martial may direct.

General Clark has used contemptuous language against the President not related to bush's desertion status; somewhat neutralizing your excellent argument. However, I think General Clark is saving the AWOL slash DESERTION salvos for a later day. Teammates will do the grunt work for the General, but he will be around to inflict the final blow to the cowardly one occupying Al Gore's residence.

I think every single person running for the nomination has shown and used contempt against awol. And I would have to believe that if this were to apply to Gen Clark, then waht about Kerry? Is he, or is he not, a retired Lt? Is he not subject to the same thing? Geez, I don't think anyone running for office wouldn't want to show contempt for the illegal resident of the WH at the moment.

And yes, ITA - Clark is too smart for them. Period.

13. I'm not up on the UCMJ, but
I'm pretty sure it ceases to apply when you're a civilian. I would think retired military would no longer be bound by the UCMJ - if it happened after you left the military, it's governed by civilian codes of justice.

Then again, that's just my uninformed opinion.
