Jeb Bush's "Terri's Law" was found unconstitutional
in the sixth judicial circuit court on may 6, 2004 and then by the florida supreme court on spetember 23, 2004.

why wasn't he fined (or put in jail?)

didn't he break the law by enacting an unconstitutional law?

findings of supreme court of florida (no. sc04-925): "This Court, after careful consideration of the arguments of the parties and amici, the constitutional issues raised, the precise wording of the challenged law, and the underlying procedural history of this case, concludes that the law violates the fundamental constitutional tenet of separation of powers and is therefore unconstitutional both on its face and as applied to Theresa Schiavo. Accordingly, we affirm the trial court's order declaring the law unconstitutional."

were there any repercussions against jebbie for this little oopsie he made?

1. No
there is no penalty for passing or signing an unconstitutional law. It would be a nightmarish morass if it were.

3. Yes, typically the legislature who enacts and a governor who executes are
immune from such matters.

2. Uuuummmmmm . . . politicians do things to get votes, period.

Uuuummmmmm . . . politicians do things to get votes, period. Particularly, the unethical, immoral bastards such as John Ellis (JEB) Bush and his idiot brother in the whitehouse.

Never assume that Jeb doesn't have a competent bevy of attorneys at bay to do his legal research and to counsel him at every corner! And at the Florida taxpayers expense too. Of course he does. Thus, he was advised that the so-called "Terri's Law" didn't stand a chance in hell of surviving constitutional muster. Didn't the Florida Supreme Court tell him so? Didn't he jump it into federal court all the way up to the 9 Supremes who then told him so again?

On the other hand, Jebbie-boy got what he wanted. Publicity. And votes. Smile for that camera, Jeb-boy! Show us how sleazy you are, boy. Idiots eat this crap up. And its these very idiots who voted the Bush boys into office too.
