Dallas man first convicted under fetal protection law

DALLAS -- A Dallas man found guilty in the gang-related shooting death of a pregnant woman became the first Texan convicted under the state's law protecting the unborn.

Emmanuel Rogers, 21, was convicted of capital murder Friday in the December 2003 deaths of Virginia Ramirez and her 9-week-old fetus.

The new law, implemented three months before the shooting, expands the definition of an individual to include a fertilized egg.

His defense attorney noted that Ramirez had marijuana in her bloodstream and lived with a drug dealer and that there was no way to be sure the fetus was alive at the time of the shooting. But a medical examiner testified that Ramirez and the fetus appeared to be healthy at the time.

1. We need to clarify the zygote's rights . I thought 120 days was the
standard with Roe v Wade. Is this a 'states' rights' matter now setting time limits ?

There are no guarantees that a pregnancy at 9 weeks will run to term and produce a child! What are these people smoking?
