Question, If fraud is proven, even if it takes a couple years, can Kerry
get sworn in?

How does that work?

1. I think so...
First Bush and the cronies have to be kicked out. There could probably be an emergency election, and if fraud is proven, the Dems will sail in.

Not that it will ever happen. I am very cynical.

2. AFTER THE SWEARING IN the shrub would have to be impeached to be removed
fraud would have to be known about by bush

3. I don't believe so.
I think that once the vote is certified, the vote is considered "official". After that, if fraud is proven, those responsible may go to jail, but the result of the vote is not changed. I think for fraud to change the result, it would have to be proven before the certification. This is just my understanding, I could be wrong.

8. You are correct. If * and cheny were to be impeached and convicted...
the house speaker, Hassert would become president.

15. That is true, but I would expect a Nixon style
resignation and appointment of a new Vice President who would become President. Both Bush and Cheney would get pardons from the new President.

24. That IS if Bush was innaugurated first...
There is still the possibility of a Temporary Restraining Order requesting postponement of Electoral College voting, based on Fraud charges. And there ARE the "War Crime" charges which have been entered BOTH in Canadian courts AND German courts recently. (And now with NEW prisoner abuse photos...)

A lot can still happen between now and January 20.
Keep the faith!

We missed our chance at defending Democracy when Kerry
failed to lead this fight. I am very very certain it is way way too late. We have ceded all power to the pukes.

32. We lost earlier than that...
we lost when the freaking system was set up so that all nominees are in effect chosen by Iowa and Hew Hamster. Staggered primaries guarantee that most states are shut out. Terry McCauliff orchestrated most of it this time to accentuate that effect. Demand a national one day primary and we may start nominating some folks that appeal on a national basis. Until then expect Dukakis time and time again...

DA

BTW - I was a Clarkie myself but ended up voting for little Dennis when the vote finally got around to me as Clark was toast by then.

7. Nope.This question came up in 2000. The answer is no. Once..
the electors are certified and dumbya is sworn in, that's it. Constitutionally we can only have ONE presidential election every four years. And once the boob is sworn in we're stuck with him.

11. That's pretty much how I understand it.
It won't be long till it's official.

Nothing will happen between now & then to change this election.

But the fight has to go on to insure integrity of the voting system.

9. no.
the actual election of the president happens in congress. when they accept the electoral votes. once elected there bush would be president again. we would have to impeach him and impeach and jail all of his cronies. the presidency would be passed down to whoever is not in jail until 2008 when the next election is scheduled.

14. I don't mean to be nit picky, but
the actual election happens in the electoral college. It is accepted by Congress.

10. if the vote is linked....
to the white house, and can be proven a high crime and misdemeanor, then he would need to be impeached. My guestimate would be that a real investigation, absent some really compelling and revealing lawsuits, wouldn't happen until there is greater equity in the House and the Senate.

remember, with Nixon, they voted out three charges, one having to do with deceiving congress about cambodia, another about covering up the hush $$$. after all the shrubmeister's international misadventures, if iraq goes south or he tries to pull us into syria/iran/north korea, if the damns can stay unified and say "once swcrewed by a lyin exec, twice shy" it will place a much higher threshhold on the turth-

so i think that there is certainly a possibility that by 2006, if the demo's manage to wake up and start humping the enfranchisement issue, and the congressional balance gets closer and some of the wingnuts are gone and delay is in jail, and....

well, maybe then there can be impeachment hearings.

12. Bad NEWS
Once the election is certified by Congress it is FINAL. The only way it would change is if Bush was personally implicated and he would still have to be Impeached and found guilty to remove him. The remedy for fraud would be criminal prosecution of those involved.

13. If it is exposed close to the mid-term elections, the Dem's could
take control of the house and senate and then impeach the sorry bastard and prosecute his entire cabinet.
That would be justice to have them all locked up.
We could use Abu Grab prison for their incarceration.
I do however believe once the schmuck is sworn-in, it requires impeachment to and the a Sentencing by the Senate to throw the bastard out.
But think of the damage he will manage to do in the mean time?

18. I wish I would have read this before I posted
my question - I would have just posted here. My question was a variant on this one though: does Ohio election law provide for a way to recall electors once they have been assigned to Bush? If Blackwell does what he's pledged to do and certify the vote on December 13th for Bush and then a recount shows at the end of December that Kerry actually won, what happens? Do two sets of electors end up being sent (in which case the Repugs would have the ability - which I have no doubt they would do - to choose Bush despite the fact that Kerry actually won)? What happens?

20. Actually, I believe the electors can vote for whomever they please
so if they are Republicans, they'll vote for Bush.

Someone correct me if I'm wrong.

19. When congress certifies the vote, isn't it that it take only one senator
and one congressman to contest the election? And in that case it goes to a vote?
That is, at least, a stinky taint to have on the presidency.

23. But that's the rub...
as I see it. Even if Kerry wins the recount and a Democratic senator speaks up and challenges the electoral count, it will simply throw things into the House where the Republicans will vote for Bush and he'll win that way.

No matter how you look at it, I just don't see how we win once the Ohio electors are assigned a week from Monday.

27. It's actually slightly different ...
I believe I recently read that if the vote of the Electoral College is challenged and at least one Senator stands up for the challenge, then the House must vote BUT (and this is important), each state gets just one vote! Unfortunately, that means that CA and NY votes are equal to the votes of WY and UT, so it does not look good.

Of course if the fraud is clearly proven and the whole country is angry about it regardless of political party, who knows whether it would be safe for all those small red states like WY and UT to vote to keep Bush?

Once it gets past that date (early January) it is over and Bush is inaugurated on Jan 20. After that impeachment is the only way out and the rules of succession come into play. There is not a new election until 2008

34. I agree. The best we can hope for is putting a stink of
illegitimacy on the presidency again. And, perhaps people will be motivated to protest like in Kiev, but let's not get our hopes up.

21. In order for Bush to be impeached, he would have to be personally
implicated in the fraud. This is unlikely to happen. However, proof of fraud would probably be very helpful in the court of public opinion, regardless of when it is proved.

22. In order for bunkerboy to be impeached, the repukes would have to behave
with honor and integrity and hold the constitution higher than their party.

Not.
Gonna.
Happen.

As I and others have said many times before, bunkerboy could fuck little boys on network television, and 1) it would never be broadcast in the first place, and 2) they would blame the boy.

Don't believe me? Think Arnie & Rudy - they LOVE them. Change their "r" to a "d" and they'd be villified.
