1. That presumes that there will be an issue for the SCOTUS

You gotta have something substantial to get a hearing there, even with Scalia still drawing breath.

2. Rehnquist probably won't be up to it this time

3. I think Bush loses if it goes to the Supreme Court.

At least one of them will swing positions, if not more. In fact, I would be surprised if Bush got more than 3 of them. Perhaps even only 2 (Scalia and Thomas are guaranteed, of course). I don't think they're going to repeat their mistake, and I also think that several of the more conservative members have recognized that Bush isn't a Conservative, but actually is Bat Shit Insane.
