What if Kerry wins the Electoral vote, but loses the popular vote? (Note: I am not saying this will happen and am not trying to discuss whether it will happen).
It has been reported that the Bush* campaign in 2000 was prepared to challenge the result in court if he won the popular vote but lost the electoral vote. When the opposite happened, they quietly buried their plan.
Do you think that the Bush* mafia would try to challenge a Kerry electoral vote win if Bush* had a popular vote majority? I know it would be hypocritical of them (what's new) and the legal basis is zilch, but would they?
I wouldn't put it past them. At the very least I would expect them to challenge the results in the states with the smallest Kerry majority. They'd get recounts and try to throw out votes. They'd fight every inch of the way and the press wouldn't be calling on them to accept defeat like they did Gore.
