9/11 National Emergency Declaration Extended Under Obama
Extension Keeps Previous Administraion's Emergency Powers Intact

President Barack Obama has provided a notice in the Federal Register and delivered a copy to Congress indicating he has renewed the state of national emergency.

In his letter to Congress, Obama pointed out that the terrorist threat continues and that the powers and authorities adopted by the previous administration must go on past September 14th, 2009. The National Emergencies Act
limits a state of emergency declaration by terminating
annually, unless consecutively renewed by the President.

While the notice to Congress and the Federal Register is generally viewed as routine and ceremonial, the renewed declaration emphasizes a potential continuation of anti-terrorism policies of the previous administration, including an implied deterioration of civil liberties associated with a declaration of national emergency.

In its 2007 report, the Congressional Research Service concluded that under declarations of national emergency "the President may seize property, organize and control the means of production, seize commodities, assign military forces abroad, institute martial law, seize and control all transportation and communication, regulate the operation of private enterprise, restrict travel, and, in a variety of ways, control the lives of United States citizens."
