I carried for years before I received an Ohio license. Ohio had an affirmative defense statute that allowed one to prove need after the fact to a judge or jury. I figured if I needed it badly enough to use it, I could prove that I needed it. That was a big reason I've never had a speeding ticket.

that I've had a Florida CWL for several years that is good in KY, TX, and most of the other states I visit.

Forgive ne, but am I reading this correctly? The reason why you have never received a speeding ticket is because you carry? So, uh, the ticket gets dismissed after the judge gives you time for pulling your weapon on a cop who would dare ticket you? :P I think I know what you mean, but clear that up for me if you can - I think its an interesting point. :hi:

I meant the reverse. :) Carrying in Ohio pursuant to the affirmative defense -- meaning I could prove my justification after being arrested and prosecuted -- I had added incentive to not speed, or have a busted taillight, or have a dirty license plate, or do anything that could get me pulled over.

43. Who knows?
I was not a criminal because there was never a prosecution, and there was no way to tell if you were committing a felony without being prosecuted. The way the old statute was written terribly vague. It essentially said that you can't a concealed weapon, however, you are not guilty of illegally carrying a concealed weapon if you have a reason to carry such as would justify a prudent person in going armed. It was up to a police officer, a prosecutor, a grand jury, and a judge/jury to decide whether one had a good reason to carry.

4. Question too for CCW?
From a CA Gunowners site:

""GOOD CAUSE (See Bottom of page for examples)

Good Cause is the set of circumstances which distinguishes the applicant from the mainstream and causes him or her to be placed in harm's way. Good cause is NOT a simple fear for one's safety. Applicants applying because of business reasons will be required to demonstrate they are in active, legitimate business. Employees applying because of job duties must provide validation of those duties. Persons applying because of threats or personal protection needs must submit copies of police reports, restraining orders or other documentation substantiating their concerns.""

Can I ask any CCWs to share what their documented good cause was that allowed them to receive their CCW?

(Please note, I'm not a flamer.. don't care that you have a gun.. or even carry it concealed. I'm really curious as what regular people say on these applications and how critically they are looked at by the ones approving the license. Thanks in advance!)

"Good cause" is not an issue in the 35 shall-issue states -- or in the 2 states that do not require permits. It is only an issue in the 9 states, including California, which may or may not issue permits depending on who you are, who you know, and what your reason is. Most of the shall-issue states don't ask for a reason. If they do ask, putting "personal protection," "all lawful purposes," or something along those lines is satisfactory -- since the answer doesn't really matter. All that matters in the shall-issue states is that you meet any training requirements and pass the requisite background checks.

In the may-issue states, factors such as running a business and making large cash deposits or receiving threats on your life are typically required. In some states, counties, and cities -- e.g., NJ, NYC, Hawaii, LA -- it is next to impossible to get a permit unless you are somebody or know somebody.

Training requirements? That's a very good start, but are these requirements across all the states, selective, and/or rigidly enforced?

11. Training requirements
Training requirements run the gamut from non-existent (IN, PA) to basic (FL) to reasonable (most states require somewhere between a half-day to a full-day class) to substantial (OH, 12 hours, and AZ, 16 hours). Some states certify trainers themselves; some allow any NRA-certified instructors to give classes. Typically the instructors have to provide a certificate attesting to the completion of the training. Providing fraudulent certifications is a criminal offense, so fraud is rare.

I'm not an expert in what "good cause" is acceptable in the nine may-issue states (CA, HA, IA, NY, NJ, MD, MA, DE, RI). In many cases, such as CA and NY, it varies widely between counties.

Okay, I know that phrase is as hollow as 'personal responsibility' to many, but it is good that at least the attempt is being made to ensure some training in most of the states. But I'm sure we'd all agree that even if it's not a State Requirement, it should be a Personal requirement. <wishful thinking.. hope springs eternal.. insert cliche here>

20. Okay, slowly backing away...
Y'know it's ALWAYS the minority within groups that give the entire group a bad name (and that is NOT fair...)

But it really is saddening that some of the very people who are so adamant about gun-ownership & carrying them concealed will circumvent the system (training & licensing) to save a little bit of time or money.

Oh well if we lived in a perfect world.....

<BTW don't misconstrue the above statement.. believe me if I felt in immediate danger and had a definite need for that type of protection, I'd risk the fine/arrest over letting myself be an easy target. I am speaking more about the people who just bypass the system for no necessary reason>

45. Circumventing the system
I don't take any offense at your remarks, but I carried in Ohio without with an Ohio license to carry at a time when no licenses were available in Ohio. I wasn't circumventing the system. I already had licenses from PA and FL that allowed me to legally carry in over 20 states, but they weren't recognized in Ohio. I applied for an Ohio license the first day licenses became available, April 8, 2004. I had the license in hand a week later. I've added NH too, so I can legally carry in 29 states.

I realize after I posted my remarks that you had already admitted to doing this! And I've read your posts and think I know enough about you (first impression wise) not to worry so much about you.

You've shown you're serious and responsible and as you pointed out, HAD prior CCWs and as you later pretty much said 'everything is "legal" until you get caught' <paraphrased friendly>

I of course would wonder why you FELT the need to carry without waiting but hey, I drove a few times by myself with only my learner's permit, so nobody is perfect I guess.

We really should keep our conversations and attitudes to those who flagrantly, frequently, and without ANY regard to laws & ordinances and not worry about the few times we've all 'called in sick to work when we weren't really that sick'!

as I'm sure you know, "some animals are more equal than others." When I carried without a permit, technically it might have been illegal (that's debatable) but there's no way in hell a cop would have cited me for it unless I was also caught violating a corpse while driving drunk, too.

did your dept. and DPS have a feud running?

'round here, the trooper would have lost his job over something like that....not for issuing the ticket, mind you, but for threatening interdepartmental cooperation. I've personally seen folks fired for pulling that kind of crap....

a local LEO that I know personally got into trouble for being a figurative cheesehead in this kind of situation. He was fired, and is now working as a MallNinja at the local mall. I have trouble keeping a straight face when I run into him.

If you give some people a badge, they begin to act badly. That's why I got out.

10. It makes carrying a gun and ammo more easy...
for example, in many states, one must separate the gun and ammo while transporting both of them...merely have an unloaded gun in the same compartment as a case of bullets is not good enough.

Now that I have a CCW, I don't have to worry about that, they can ride together.

I can also now legally carry my pistol when it is concealed, which I couldn't before.

21. I'm more uncomfortable a higher percentage of the time.
Carrying a concealed handgun is often a pain in the butt. Carrying one every day is, in effect, a lifestyle change. You have to dress differently and take your current status into account when deciding where you want to go and what you want to do.

...the air is fresher, water is purer, I walk with a spring in my step, sex is better (had to toss that one in), flowers smell better, my wife is prettier (and nags less), all of lifes pleasures are more pleasureable ever since I got my CCW.

I have moved to a rural area, gotten married, have five wonderful children, changed jobs twice...Life is good.

Would it have happened without a CHL? Yes.

Would I be happy without a CHL? Yes.

Since a CHL and weapon are available do I have a permit, train and carry? Yes. (I also carry a fire extinguisher, emergency communications equipment--2 meter radio--and first aid kits.)
