Man fires into windshield to prevent theft.
http://www.waff.com/story/15331529/deputys-wife-shot-while-committing-burglary

Investigators said Brewster was shot outside of a home on County Road 365 in Pisgah and not in her car as she originally reported. Investigators uncovered that Brewster may have been in the act of committing a felony burglary just before the shooting and that the victim of the robbery shot Brewster.

I think there's red meat here for both sides....so I'll just leave it here for everyone.

3. "Kirby said when the intruder attempted to run over him that's when he fired into the windshield"

The shooter may have been defending self while acting lawfully.

6. But the article also says "not in her car", which makes it hard to imagine how she was
going to run him over. Lot of vagueness in this write-up.

Still, I don't see any reason yet to doubt his claim of self-defense -- and even if it is debatable, the tie goes to the not-a-burglar in such a case, IMO...

4. Reads like a righteous defense
of life and property.

No "red meat" here, just chicken.

Semper Fi,

5. If this is what it takes to get away with shooting the spouse of an officer, I'm all for it.
You just have to catch them in the act. Too bad it doesn't work for actual officers - somehow, catching them redhanded in the middle of a felony isn't enough excuse to defend yourself.

Is that enough bloody carcass for you?

8. Actually, police shooting are ruled justified when someone threatens to run them over too.

Have you been paying attention to these issues at all?

10. Actually, (at least in some places) it is legal to use deadly force against...
a LEO if they pose an unjustified threat to your life. But being legal doesn't necessarily mean that the event or likely subsequent arrest is survivable.

11. I'm not sure I would have shot at the apparent thief...
but I'd rather have the onus fall upon the thief than the alleged victim of the break-in and theft (let alone any alleged attempt to use a car as deadly weapon). Victims of crime should not be subject to the scales of proportionality and appropriateness after-the-fact. Let that fall upon the initiator of the felony.

9. Lesson learned.
Don't take shit that doesn't belong to you (something most 5 year olds can grasp) and when you get caught, don't try to run down the armed individual you're stealing from.
