.....A report by ABC News affiliate KGUN found that more than an hour had passed before the SWAT team let the paramedics work on Guerena. By then he was dead...

In a statement, the sheriff's office criticized the media, saying that while questions will inevitably be raised, "It is unacceptable and irresponsible to couch those questions with implications of secrecy and a coverup, not to mention questioning the legality of actions that could not have been taken without the approval of an impartial judge." ...

.....Storie defended the long delay in allowing paramedics to enter the home, saying of the SWAT team, "They still don't know how many shooters are inside, how many guns are inside and they still have to assume that they will be ambushed if they walk in this house.".....

....He pointed out that when Rep. Gabrielle Giffords was shot in Tucson, law enforcement let paramedics have access to victims in a far more volatile situation...



Silly lawyer! Doesn't he realize that the people at the Giffords rally were more equal than his clients' deceased husband?

And if you'd read the article linked, you'd know that the decedent had relatives killed by home inavders.

I'd also be skeptical of someone claiming to be a cop.

In this case, the claim that the late Mr. Guerena fired on the SWAT team, which the PCSD then had to retract and admit that the shot fired, and which arguably prompted the barrage of fire (71 shots, of which 60 hit Mr. Guerena), was a negligent discharge by a SWAT team member, whereas Mr. Guerena's AR-15 was unfired with the safety engaged.

Initial claims that drugs and money were found in Guerena's house were subsequently changed to "oversized drug paraphernalia" until the PCSD spin doctor, Lt Michael O'Connor had to admit those were actually found in a different house.

The PCSD had to retract those claims because they were contradicted by physical evidence. We can only wonder what other claims they've made that are bullshit but which they haven't been forced to retract yet...
When five SWAT members broke through the front door Guerena was crouched down pointing the gun at them, said O'Connor.

"The suspect said, 'I've got something for you,' when he saw them," O'Connor said. Guerena's wife denied he said that.

Yeah, a Marine with two tours in Iraq under his belt is going to hold his fire long enough to get off a posturing line like "I've got something for you." Suuure, that's totally plausible. Why not just go all the way and claim he said "say 'ello to my leetle friend"?

In the interim, PCSD have refused to disclose the details of the warrant that led them to bust down Guerena's door, or what--if anything--they actually did seize from the house.

11. Really not a fan of no knock warrants
They have a time and place, but they are really overused and even abused. Supposedly they are hard to get as well so I can see people may be stretching the facts to obtain them

Note: The PCSD is trying to keep the search warrant and accompanying affadavit secret, and the AZ Star is suing to unseal them.

Maybe, as it's been alleged, Jose Guerena was part of a home-invasion ring with family members, ripping and running with body armor and assault weapons, posing as law enforcement.

But all we know, more than two weeks after SWAT officers shot him 60 times, is that Guerena was a Marine who served in Iraq and had no criminal record. We know he worked the night shift at the Asarco Mission Mine, and he was a father and husband.....

......Could Pima County Sheriff Clarence Dupnik have bungled the explanation for this shooting any worse? His department first said Guerena fired at the SWAT officers. Then it said he didn't. The officers now say he raised his gun with the safety on and pointed it at them. Since the correction, Dupnik has refused to comment on what went down....
