Florida statute says a person with a concealed weapons permit is allowed to enter any municipal building, without restriction, so long as there is no business meeting (such as a city council meeting) happening at the same time. The Libertarians seem to be suggesting the City of Boca Raton is unlawfully banning a citizen to bring a weapon into City Hall - a direct violation of state law. Florida Statute 790.06 Paragraph 12 is very specific in allowing a concealed weapons permit holder to carry a weapon into City Hall and Florida Statute 790.33 inhibits municipalities from violating that right.
Libertarian Party of Palm Beach County chairman moran, John Thompson said today, "Ending the confusion over the rights of the people will make the City Hall of Boca Raton a safer place to conduct the people's business." Mr. Thompson mentioned they can make a simple change to the sign to comport with state law and mentioned similar efforts have proven successful throughout the state and include Tri-Rail. In 2009, Tri-Rail had similar signs posted stating weapons were not permitted on board their trains and the signs were challenged by a Florida resident. The signs were then changed to comply with state law.
In their letter to the mayor, city council and the city manager, the Party cites Florida Statute 790 and suggested in their letter, should the City not remove or change the sign within 45 days from today, they are prepared to file a Petition Seeking an Administrative Determination and/or file a complaint against the city in state court.
