Bush nominee to San Diego bench gets ABA rating of not qualified
I didn't see this in the LBN forum, and it's a slow enough process that it seems appropriate for J/PS. Mods please lock if this is a dupe.

...Roger T. Benitez, a federal magistrate judge nominated to be a U.S. district judge, was given a not-qualified rating by the American Bar Association, a Chicago-based nonprofit group that counts 400,000 lawyers as members.

The rating surprised his supporters, who describe him as a hard-working judge who had to overcome obstacles as an emigre from Cuba. Benitez came to the United States at age 10, accompanied only by his 13-year-old brother.

An unfavorable ABA rating means the group believes the nominee does not meet its standards of professional competence, judicial temperament or integrity in some way. The group, which has appraised presidential nominees to the U.S. district, appeals and Supreme courts since 1948, issues such ratings after interviewing members of the nominee's legal community.

Most judges get a highly qualified or qualified rating. In three years of the Bush administration, four judicial nominees have received a not-qualified rating....

This is not unprecedented and it doesn't necessarily mean the guy is a total loser. President Clinton submitted four judicial nominees who were deemed not qualified by the ABA. I see this as more evidence of the need for a vibrant opposition party in this country. It's going to be a long four years if GWB wins in November. May the Senate Judiciary Committee do the right thing whatever that turns out to be. I'm curious as to why judge Benitez is seen as not qualified. He had no comment when asked if he knew why.

3. Guess This Explains Why...
...Pretzelboy announced early in his mis-Administration that the ABA would not be consulted regarding judicial appointments.
