NY mayor conducts gun-sale sting in Arizona (Blowback agin Bloomy starts)
Edited on Mon Jan-31-11 08:22 PM by shadowrider
says not much has changed after tragedy in Tucson

-- snip --

"Mayor Bloomberg and his `task force' have no legal authority in the state of Arizona, or in any other place in America except New York City," said the statement from the Crossroads of the West Gun Shows. "These forays into America's heartland committing blatant acts to entrap otherwise innocent gun owners is an unlawful scheme that is created by Bloomberg's task force."

-- snip --

"It's not a prosecutable offense" because the purchasers were not truly felons, minors or drug abusers and because they didn't tell the sellers definitively that they were, Cavanaugh said. As for Bloomberg, he said, "ATF has asked him not to do it and to please coordinate with ATF if he thinks a violation is occurring."

Any peon would have been arrested and in jail right now awaiting trial had we tried this. The blowback against Bloomy is starting.

1. Busybody nanny statism again
Arizona authorities should politely escort Mr. Bloomberg's agents out of the state, as they have no authority there.

3. Do you have the same problem when reporters do it?
The NY officials weren't arresting anyone. They were simply gathering data and exposing the ease of buying weapons at these gun shows.

4. If these were NYPD investigators presenting false credentials, it was a felony.
In multiple clips, private sellers ask to see someone's ID to make sure they are state residents. The investigators present Arizona ID.

eg, http://www.youtube.com/watch?v=gv2u7l8rKrQ

7. LOL.
Let me get this straight: You're incensed because investigators used fake IDs to prove how easy it is to get around ID requirements at gun shows in AZ.

12. Incensed? No. I just want to know when will they be arrested.
Since they were out of their jurisdiction, they have no immunity from the law. Cops on duty have 'qualified immunity' in their jurisdiction to the extent necessary to perform their job.

Just like a cop can't flip on the lights and sirens just to get to his son's softball game on time, local cops can't go around the country breaking laws willy-nilly.

17. Bloomberg says they are AZ residents.
Probably PIs hired by NYC to do the investigation.

18. Oh don't be silly.
You can't possibly think something happening in another state might impact another. I mean it's not like there are open borders between the sovereign nations of NY and Arizona, right? That would be as ludicrous as Arizona wondering if lax environmental standards in Colorado are the result of the pollution in their drinking water. Just balderdash, I say!

24. "Bloomberg's office said all the investigators were Arizona residents and broke no laws."
Could be the other report messed up. Seriously, I bet they hired local private investigators. Much cheaper than sending NYC people out here.

33. I suspect it's due to Bloomberg sexing up his press release
And a bunch of journos not spotting (or not caring) that "we sent a team to Phoenix" sounds way more dramatic and hardcore than "I had an underling hire some private dicks from the Phoenix yellow pages," even though the latter would be the more honest description of events.

34. Of course, if no laws were actually broken, that undercuts Bloomberg's whole point
In fact, it starts to verge on the Pythonesque. I'm thinking specifically of the sketch "The Day Nothing Happened" http://www.wepsite.de/The%20Day%20Nothing%20Happened.htm

5. Reporters and LEO's have very different rules and laws to work under.
These people lied, used fake ID, and broke laws to show that... private sales are legal when there is no way to verify someone's ID or shitty jokes.

I want the raw footage of the tapes, not the carefully edited smack we got in the MSM. But I won't hold my breath.

Sorry if the results are embarrassing to the gun show lobby.

11. So I could commit a felony but also be immune to prosecution?
I mean, after all, I don't want to arrest anyone, just want to commit felonies without fear of charges.

Because some dumbass AZ State Legislator thinks it is?

31. Reporters aren't cops.
It's a matter of police using authorities outside their scope.

Reporters in many states can make recordings of conversations without a warrant.

Would you grant the same power to the police or do you like the government on a leash?

8. May I ask how many times you have used the phrase, "We don't need more laws!
...Just enforce the one's we have!"

I'm sorry to say, but if someone goes and shows you those laws (or regulations) are not being properly enforced, whining about "nanny statism" makes one a hypocrite.

Not to put too fine a point on it, but you are not exactly giving "responsible gun ownership" a good name when you blame the messenger.

I bought my gun 20 years ago in Kentucky at a flea market. It came to Washington State with me 5 days later and has existed here ever since.

There is a flaw in your reasoning.

25. let them concentrate on the "loophole," it'll keep them distracted as we work
to get new full autos available again and dump gun control around the country. In the end all they will be able to do is to outlaw private sales between residents of different states.

32. Bloomy is merely attempting to draw attention from NYC's failed policies...
He can't even fix potholes and keep his streets plowed , much less safe. The criminals love the wide assortment of unarmed potential victims to choose from in his fair city.
