McDonald v. Chicago decision could be coming down tomorrow
Maybe this is wishful thinking, but I would like to hope that Obama would make a statement supporting the ruling that I think the court will issue (striking down Chicago's handgun ban). I can hope, can't I?

By Clifford M. Marks

scotusReaders, consider yourselves duly warned. You need to be well-rested and alert Monday when the Supreme Court is expected to issue four big-time rulings.

Here’s a quick preview of the cases; consider this like a glimpse at test questions ahead of the big final.

In McDonald v. City of Chicago, which involves a challenge to a Chicago handgun ban, the court will weigh in on whether the Second Amendment can be incorporated into the 14th Amendment so as to apply to the states. As Ashby Jones, our esteemed colleague who’s due back Monday from a well-deserved vacation, once said about the case: “It’s not an understatement to say that the entire gun-control regime in the U.S. hangs in the balance.” The smart money is that the court will rule 5-4 that the 2nd Amendment constrains the right of states to regulate firearms.

1. Since the bush era, I have come to support the notion of NO GUN CONTROL
Why was it that about the only effective actions the US FEMA people took after Katrina was that of going door to door and taking away people's guns?

Why don't they want us to be able to protect ourselves?

I would much rather see them take away the ability of local DEA people to use SWAT teams than to take away people's right to have guns.

11. It wasn't FEMA that did that.
The order was given by New Orleans mayor and by the Chief of Police. It was local cops that took away people's guns.

20. Very true, and that action was a big influence
in my decision to learn how to shoot keep arms in the home. Who is to say that a ultra-RW government won't do it next??

3. Damn, that's sad ...

Husband of Supreme Court Justice Ruth Bader Ginsburg dies

Martin D. Ginsburg, 78, a Georgetown University tax law professor whose blind date more than a half-century ago with a quiet undergraduate named Ruther Bader blossomed into an enduring marriage, died June 27 of complications from metastatic cancer at his home in Washington.

Mr. Ginsburg joined the Georgetown faculty about 30 years ago and was one of the nation's preeminent tax law experts. He was also the doting husband of history's second female Supreme Court Justice, playing the roles of sounding board, moral supporter and intellectual sparring partner.

The couple celebrated their 56th wedding anniversiry on June 23. The foundation of their relationship, they both said, was mutual respect and equality. emphasis added

7. “It’s not an understatement to say that the entire

gun-control regime in the U.S. hangs in the balance.”

Hmmmm.........I'm taking a wait-and-see posture on this. California's new law taking effect next year requiring fingerprinting for ammo purchases is a classic example of obnoxious legislation designed solely to serve as back-door gun "control". It will have ZERO effect on violent crime, but it sure will make life tough on gun owners and dealers, won't it?

8. Kind of like legislation that makes women jump through many hoops to get an abortion
For ex: waiting periods, mandatory ultrasound viewings, being forced to listen to a state written lecture about abortion being recited to you by a nurse.

The Georgia legislature once considered a bill which would have required the mother and the doctor to sign a "death warrant" (yes, that's what they actually called it) before the abortion could be performed.

If Alito's the author and signs point to him as such, we may not get strict scrutiny. He's too "pro-police" / police statist to go full strict.

9. their analysis is too simple
there is more than one issue at stake. We not only have to answer if the amendment is incorporated, but "how much" of it is. Their is no doubt that the court is almost unanomous in agreeing that the atleast some part of the second amendment should be incorporated. I say the 7-2 or 8-1 striking the handgun ban. I think that during the arguements it was quite clear that even the 2 of the 3 dissenters in heller conceded that the handgun ban was to be struck down. Remember, they spent most of the oral arguements grappling over standard of review and how far the amendment should stretch and that they held the base point at a handgun in the home for self defense. This leads me to believe that they already knew that the handgun ban had no chance of survival and that the only discussion was really how much further the amendment should go.
