NEWSDAY: Carolyn McCarthy to unveil new semi-auto ban next week

Since her appointment to the Senate, one-time NRA favorite Kirsten Gillibrand has passed just about every test on guns set by Rep. Carolyn McCarthy - but that might change next week.

But McCarthy said that next week she plans to introduce an assault weapons ban - legislation that is anathema to the NRA and that could pose a problem for Gillibrand.

"I think the assault weapons bill will be a test," McCarthy said Wednesday in an interview.

Gillibrand had no comment Wednesday on legislation that hasn't been introduced, said her spokesman Matt Canter.

is considered an assault weapon

it is a remington 870 pump action shotgun which happens to be one of the top sellers as a home defense gun

(L) A semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General. In making the determination, there shall be a rebuttable presumption that a firearm procured for use by the United States military or any Federal law enforcement agency is not particularly suitable for sporting purposes, and a firearm shall not be determined to be particularly suitable for sporting purposes solely because the firearm is suitable for use in a sporting event.'.


Cops & military carry pump shotguns, so..

(It's a stretch, but not beyond the "logic" of some of these folks.)

I think I see your point in that the word semiautomatic is missing from that particular clause. But it would be a stretch.

Also are assault weapons the only thing bad for drunks to have? Would it be ok for a drunk to have a hunting rifle in hand?

Here are some lowlights...

Reduce allowable scary features to 1:
(D) A semiautomatic rifle that has an ability to accept a detachable magazine, and that has--
(i) a folding or telescoping stock;
(ii) a threaded barrel;
(iii) a pistol grip;
(iv) a forward grip; or
(v) a barrel shroud.


limited mag caps:
(G) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.

included many basic shotguns:
(H) A semiautomatic shotgun that has--
(i) a folding or telescoping stock;
(ii) a pistol grip;
(iii) the ability to accept a detachable magazine; or
(iv) a fixed magazine capacity of more than 5 rounds.


added all kinds of great old weapons like the M1 Carbine, the M1 & M1A:
(A)The following rifles or copies or duplicates thereof:
(xi) M1 Carbine;

(L) A semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General. Consider it stupid.

But she did have her husband killed and her son seriously wounded in the Long Island Railroad shooting. Just like I cut Jim Brady and his wife a break.

15. What happed was a tragedy
but the tragedy did not make her an expert on the matter. It is apparent by her public statements that she does not have an understanding of firearms or existing firearm laws.

I can not cut someone a break when they want to pass laws based on emotions not facts that will affect a large number of people.

with a 9mm handgun. WTF does that have to do with an assault weapon ban? Her lifes mission is to get a permanent AWB when "assault weapons" had nothing to do with the shootings she was involved with.

12. Sorry, I overlooked your earlier OP. Below is my statement from my later OP.
The anti-RKBA team wants Gillibrand to join Schumer (NY), Kennedy/Kerry (MA) and Feinstein/Boxer (CA) to destroy one of our pre-existing rights that government is obligated to protect as enumerated in the First, Second, and Fourth Amendments.

The six votes by senators from NY-MA-CA on the anti-RKBA side will be nullified with six votes from WY, MT, and SD senators for the pro-RKBA side.

Gillibrand was elected with pro-RKBA support. It’s a sign of respect to dance with whomever brought you to the dance.

16. K&R with unrealistic optimism that at least one DUer will learn a wee bit about RKBA, a divisive,
polarizing political issue for which IMO there is no possible compromise between (a) those who would prohibit a pre-existing right protected by our Constitution and (b) those who support allowing each citizen to decide whether she/he exercises that right.

Examples of such issues for which IMO compromise is impossible between prohibition groups and choice groups are:
- Abortion
- GLBT rights
- RKBA
