— Harris & Stephenson
Bev Harris and Jim March seek restraining order against Diebold Election Systems — On Tuesday at 9:45 a.m. at the Sacramento Superior Court (Dept. 53, on 800 9th St., Sacramento California) Plaintiffs Jim March, Bev Harris, Joseph Holder, Jim Hamilton, Douglas McDonald, and the Community Labor Alliance will seek a restraining order against Diebold Election Systems. Diebold attorneys have been sent a copy of this lawsuit, which seeks an order requiring the DIEBOLD defendants to disgorge and make restitution of any money or property acquired by means of their unlawful, unfair and fraudulent acts and practices.
The attorney representing Harris, March, et. al. is Lowell Finley, who recently won the $4 million campaign finance violation suit against Arnold Schwarzenegger.
Washington Secretary of State Sam Reed has also received a lawsuit, by Andy Stephenson on behalf of the People of the State of Washington, seeking decertification of the GEMS 1.18.18 system that was improperly certified and has now been used in two elections. In Washington state, contrary to state law, the firmware for the optical scan machines made by Diebold was never certified at all, and Stephenson's suit also seeks to require certification of all optical scan firmware before the next election.

10 California Counties Revolt Against Secretary of State
On Feb. 5, California Secretary of State Kevin Shelley ordered beefed-up security measures for the March 2 primary election. Ten county elections officials have launched an open rebellion against these simple and important voting security safeguards.
You've Gotta Be Replaced:
The following county officials should be replaced, as they have demonstrated that they are unwilling to provide a secure and safe voting system for the taxpayers who pay their salaries:
Riverside County: Mischelle Townsend (scroll down for more) Santa Clara County: Jesse Durazo (turned down a voter verified paper system even when offered this feature for free by the vendors) San Diego County: Sally McPherson (purchased Diebold touch-screen system AFTER it had been exposed to be riddled with security flaws)
The next group of officials should be replaced if they do not correct their behavior:
Kern County: Ann Barnett (took delivery on a Diebold TSx touch-screen system when she knew it was not certified. She should now ask for her money back under the bait & switch consumer protection laws.) Los Angeles County: Conny McCormack (Uses Diebold touch-screens and uses the insecure GEMS tabulation system with L.A.'s customized "InkaVote" voting system.) Napa County: John Tuteur (signed the security revolt document) San Bernardino County Scott Konopacek (signed the security revolt document) San Joaquin County: Deborah Hench (signed the security revolt document) Plumas County: Kathleen Williams (signed the security revolt document) Shasta County: Ann Reed (signed the security revolt document)
