The stepbrother who has been occupying our parents house was supposed to be out by now so we could sell it, by last week.
But he has this idea that we give him 3months with him paying rent, and he can come up with the
money to actually buy the house, which i think are stalling tactics again, its been over 4months
already, and this should have been in probate by now, and almost out of probate.
If we dont do this, then he will counter sue, and we will probably have to pay tons $$ to the lawyer.
So looks like he has won

1. Not sure I understand. Is he in a position to buy the house?
If so, in this market would it make sense to give him the three months? I know, here, that this is the absolute worst time to sell a house, but it's the same way during a housing boom. People want to get their kids settled prior to the start of the school year, so houses that aren't sold by September 1st generally come off the market until the next Spring.

Sorry you're going through this, sweetie.

4. Whose kids are they? Mom's or Dad's?
And, if they don't stay, will they be homeless? How well do you get along with them?

10. What does the will say? Who does the house belong to now?
Can't the sheriff just escort him out of the property?

he was supposed to be out 8nov, then we filed for the removal, and now my brother called and
said at the hearing, the stepbrother said he would counter sue, and our lawyer said that would
cost tons of $$$$
the house is the estate
so looks like he has us by the nuts,

14. If he has no money, how can he pay a lawyer to countersue?
I think there's a logic gap in yer s-bro's thinking. Call him on it.

Plus your executor brother is running the show, it's supposed to be his call.
List the house for sale subject to inspection. Is it free and clear? That would give your the best leverage. How's the market where you are?

17. If he has no $$$ he can't take you to court.
If he even thinks about it, let him know that you'll win and he'll be on the hook for your lawyer bill too. Even if that's horseshit, he's not going to be able to afford anybody to tell him otherwise.
