But the jury took 15 minutes to reach a verdict after hearing the testimony. Foreman Rick Newkirk said jurors did not believe prosecutors had enough evidence to convict Johnson of the DUI charge. Jurors also believed Johnson when he blamed his embarrassment for his poor performance on the field sobriety tests.

"Anybody caught with their pants down like that would be nervous," Newkirk said.

Deputy County Attorney Ingrid Rosenquist argued that Mees had plenty of evidence to arrest and charge Johnson for drunken driving. Finding Johnson behind the wheel naked from the waist down was not a consideration, she said.

"He didn't pull him out to do a field sobriety test because the defendant didn't have any pants on," she said.

Johnson and Kauffman told jurors that they were celebrating their engagement with friends at a Billings bar and left for home shortly before 1 a.m. Kauffman said she started getting "frisky" with Johnson in the car as they got closer to home.
