Fuck. I have to go file a complaint against my landlord.
:nuke:

Just shoot me. I complain about the guy downstairs repeatedly blowing us away with his TV and stereo, and a month later I'm the problem because the guy downstairs can hear us *walk*??? And the landlord is threatening action?

I'm sick of this shit. For every break I get, something catastrophic happens elsewhere. I'm tired of it and want it to stop.

:loveya: Well, whaddaya know, we bumped into him outside the back entrance on our way to his office, and he completely geeked. He's writing the downstairs jerk a letter as well, and he wants everyone to play nice so he doesn't have to deal with it anymore. We gave him two letters, one about the noise complaint and the other about the stuff he owes us on the lease, and lo and behold I have a brand-new wine cooler in the living room and we're finally getting our storage locker this weekend.

Oh, and the Regie du Logement is *heavily* weighed in favor of renters. Heavily. Basically, the landlord can't do a thing, and even if he did, it'd take a year and we'd be out of the apartment anyway.

Did the landlord take any action against Loudy McStereo? Or did the landlord take no action against someone disturbing other tenents with voluntary actions, but is threatening to do so over one tenent allegedly being disturbed by another tenent's necessary action to conduct a life?

(I say "allegedly" because if you take a downstairs apartment you should accept that you will hear the people upstairs moving around. This sounds like retaliation.)

We're off to the office of the governing body for these things to talk to an advisor about what out next step needs to be. And yeah, it has retaliation written all over it - with the landlord taking sides with the guy downstairs. :mad:

Between Heidi's good vibes and yours, we pretty much won the day. The Regie du Logement frowns mightily on any landlord f*cking with renters. He can't evict us, and he has to sit on the guy downstairs or we'll have enough ammo to file for a reduction in rent because we can't have peaceful enjoyment of our home. He'd have to sue the other guy to get his money back, and in any case that'd take a year. Same if the other guy requests a lower rent.

I don't think we have quite as much protection here in Ontario, at least not after Mike Harris. But I must look into it. That would be hilarious! The new landlord has already tried (unsuccessfully) to dump all of us rent-controlled tenants so he can start all over with new improved higher-rent tenants. We had a good (free) tenant lawyer and the support of a Senior City Planner who pointed out that his intentions ran contrary to by-law, that he had to apply for a permit for conversion, and that he would be about 98% unlikely to be granted one. If he ever has another stab at it I will be prepared to ask for a rent REDUCTION!

It is neither tenant's fault that the premises are not adequately soundproofed. Appropriate carpeting on the upper level will help to dampen the acoustic intrusions.

I can hear the cat running around, I hated hardwood floors before this, and really hate them now. Yeah, they look nice, but so what. GIve me some motherfucking carpet.

The killer, though, is that the landlord's agent told us and the guy downstairs that the building was soundproof. I don't hear either of my next-door neighbors, but up and down is another story. The guy downstairs cranked it up to about 15 without even checking to see if he was bothering anyone, and now he's pissed he can't play his shit loud. Oh, and he's in bed way early, so any noise we make after like 9pm sets him off.

I doubt I can master levitation to the extent of not needing to actually walk on my floor anytime soon.

and are annoying as hell. The girl takes 40 minutes to get ready each morning, which is rather common, but does so by walking back and forth the entire time. :wtf:

The dude drops shit all the time, he's a goddamn douchebag. Moron, too.

I can hear the damn drawers of their furniture opening and closing.

18. building code standards for sound
are pretty skimpy for up and down. The apartment above me had carpeting installed after my neighbor of many years ago and I both complained to the landlord, but the next tenant ripped out the NEW carpet installed because she did not care for the color. Now I have someone above me with a four year old and apparently a lot of plastic wheeled toys. She also has an old sewing machine. Like fucking thunder. Did I mention that the kid loves to dance...well, stomp?

19. I'm just waiting to see what happens when we get a washer and dryer
One of the reasons we wanted this apartment instead of the one downstairs is the W&D hookups. No doubt we'll have to keep it to every other Thursday between 2 and 2:05 pm when the moon is full. :P

There was an article in the local paper in April about how one needs to go about soundproofing between floors, and it's such a huge pain in the arse that nobody does it, even when they upgrade entire buildings.

We're as quiet as we can be, as we have been since we moved in.
