Nude driver claims constitutional right to drive naked
An attorney for David Lawrence Moore, 52, has filed several motions in District Court seeking to have four felony charges dismissed. In the motions, attorney Robert Stephens said his client broke no laws and has a constitutional right to operate his motor vehicle while nude.

Stephens also filed notice that he intends to challenge the constitutionality of the law. "The admonition ‘if you don't like what you see, don't look' applies to the alleged victims in this case," Stephens said.

County Attorney Dennis Paxinos said Tuesday that he disagrees with Moore's attorney.

"Some people's constitutional rights end when others are exposed to their shortcomings," he said.

I know you can be charged with disorderly conduct in many states, including mine, for going out in public naked. However, in the state of Georgia the car is an extension of the home, so I guess as long as you don't get out of your car you haven't technically violated any laws. Hmm interesting.

Moore was charged Nov. 3 by prosecutors who said four women complained that Moore exposed himself on Oct. 28 in separate incidents. Two incidents occurred at coffee kiosks, one near Rimrock Mall and the other in Laurel. Female employees at the kiosks said Moore pulled up in a white truck and was naked.

The drive-up coffee kiosks around here are designed so that the employee is basically forced to look downward into the customer's car. That is what makes Moore's actions seem a bit like creepy "flashing" to me.

But what the heck... let the guy take it to the Supreme Court. I want to see the "Law and Order" episode on this one! :D
