BARNSTABLE, Mass.—A convicted bank robber will be allowed to keep his $1 million lottery prize despite having violated a condition of his probation that prohibited any kind of gambling.
The agreement with probation officials was announced Friday in Barnstable Superior Court. Timothy Elliott will keep the money he won on the scratch ticket but will be required to pay a $65 per month probation supervisory fee that had previously been waived because Elliott was indigent at the time.
Elliott's attorney, Drew Segadelli, conceded that his client violated probation when he bought the ticket at a Cape Cod supermarket. But he said the violation was minor and there was never any real chance that Elliott was going to lose the prize.
Elliott declined comment on the agreement
