GRAND JUNCTION, Colo. - The Mesa County Jail inmate who was awaiting nude photographs of his wife in July had told jailers to expect them and threatened a lawsuit immediately upon learning they had been sent back without his being allowed to see them, Mesa County Sheriff Stan Hilkey said Thursday.
“He was upset because he didn’t get to see” the photographs, Hilkey said.
Andrew Duran was in jail at the time, awaiting trial on domestic-violence charges involving his wife. That case later was dropped when Jessica Duran wrote to the court, denying she had been battered by Andrew Duran, according to court records.
Jessica Duran filed a claim last week with Mesa County demanding at least $100,000 for embarrassment and humiliation for invasion of privacy and a violation of her civil rights, according to the document. Plaintiffs are required to file notices with government agencies in Colorado before they can file lawsuits.
“Why anybody would let an agency know and then be offended?” Hilkey said of Andrew Duran’s reaction and Jessica Duran’s claim of embarrassment upon learning the photos had been viewed.
